Just sent our I-130 today...hopefully it doesn't take 5 months being we're both living overseas...we shall see...waiting to hear from USCIS

what address did you put on your form?? were you told from USCIS that they will send you things being overseas? i made it known to them SOOOO many times that I am NOT living in America and that I was living in Australia with my husband. Everyone I talked to at USCIS said they won't send things overseas, needed a local address and someone responsible enough to check mail often at local address. So I put american address on application but made it known MANY times I DONT LIKE THERE... but you can send mail there and my mom will inform me of anything that is sent to me. gave them my australian address, stat dec that was notarized by a justice of the peace saying that i live in australia and the address provided! LONG story short, it has taken EIGHT months to hear from USCIS and I was scheduled for a I-130 interview in AMERICA. I tried to see if I could have it in Australia. no one knows anything and I was told If I miss the interview the i-130 would most likely be denied. so i flew back to america, had a 20-30 minute interview. no one knows why i was scheduled an interview. uscis doesnt know why.... its not a normal process!! the petition was approved. but then i recently found out that if you live overseas with your spouse and file the i-130 it will be auto expedited!!!! maybe take a few weeks! we waited EIGHT months!! and i have been living overseas with my husband!!!! of course no one at USCIS knew about auto expediting. they lied to me and it has wasted 7+ months and thousands of dollars and the stress they have put us through. sorry im ranting but im so mad! i hope you dont go through what we went through. this website is AWESOME! wish i knew about it last year when we began this process. it has SO much helpful information!!

You were told wrong. USCIS will send stuff to a foreign address. Did you find the "Petitioner living abroad" thread?

The people you call and talk to at first are not USCIS employees, they read from a screen and are subcontracted workers. You should not take advice from them. They are often called the "misinformation" line.

If you were scheduled an interview in the US it means your case has some problems that USCIS needs to address before they approve the petition, which is very rare. Has your husband ever been arrested in the US, for instance?

You were told wrong. USCIS will send stuff to a foreign address. Did you find the "Petitioner living abroad" thread?

The people you call and talk to at first are not USCIS employees, they read from a screen and are subcontracted workers. You should not take advice from them. They are often called the "misinformation" line.

If you were scheduled an interview in the US it means your case has some problems that USCIS needs to address before they approve the petition, which is very rare. Has your husband ever been arrested in the US, for instance?

Yes, it is a serious problem. The people you call should at least say, "I don't know and I cannot advise you."

Hi folks...just a quick update...

Mariah...sorry to hear that. I put our address in Israel on the form, so we'll see if that helps. I did not talk to USCIS, it just made the most sense to me. But yes, they are not very helpful, all they know to do is read from a screen. You definitely don't need to apologize for ranting, things can get quite frustrating to say the least. I hope our journey goes smoother, as I kind of expect/need/want to be in the states in late May. I am also taking into account this could go into August, but I am hoping it doesn't take even longer than that.

Now for the update...being we had to send it to family in the states for them to add the money order etc, it should only be received at the chicago lockbox today. So, hopefully I'll have a NOA1 update soon.

Also, while preparing for the next stage already, I have stumbled upon a couple of questions where the AOS is concerned. We are going through a joint sponsor and the joint sponsor makes enough money to support on her own. However, she does file jointly with her husband. So, being in the tax returns both of their names and income would be stated, should we state it on the form as well, or can we just have her info on the form being his is not needed anyway.

One more question - Being she is my wife's daughter, a birth certificate will be sent. However, there are two issues with that: 1. Her last name is different now being she is married(does that mean she will also need to send us a copy of her marriage cert.?) 2. on her birth certificate, her mom's(aka my wife's) name only has her last name and first initial. Would a first initial be enough? I don't know, it's a weird certificate I guess...does anyone else in the states know about those?

In regards to the AOS - even though both of you live in Israel at the moment do you have any assets(house, money in the bank?) this could be also part of your AOS. did your partner applied to get the tax returns from the us?

Well that's really not an issue as we have a co sponsor that makes over 50,000 dollars a year. What I'm wondering about though, is, being she does file with her husband, if he would need to be part of it too, or if she would be enough being she makes enough. Some people say yes, some people say no...
