Hi folks!

I got my 10 yr green card today (Thank you, Lord!). Well, we filed for AOS after our 2 yr wedding anniversary but we did not file for I-130. Another thing, the welcome letter says my card will expire in 2 years and will need to ROC 90 days before expiry. Now I dont know if I should ROC or not since I got 10 yr GC?

Oh this is one of those sticky wickets that we discuss all the time here on VJ. Since you filed for AOS after the 2 year wedding anniversary without filing the I-130 you are falling into the black hole of immigration law which states that AOS from the K-1 visa must be granted a 2 year CGC, but those that are married for more than 2 years can qualify for a 10 year GC--it looks like you should have filed the I-130 with the I-485 in order to get the 10 year GC. If it were me I would make an infoPASS appointment and get this whole thing resolved now rather than not filing for ROC and finding out that your LPR status is revoked and you are in removal proceedings.

A I-485 based off of an approved I-129F petition and subsequent marriage to the petitioner must result in a 2-year GC. Since the welcome letter mentions ROC, I think that you are "in the books" as a conditional resident and that you need to file ROC in 2 years. The date on your card is an error. This definitely requires an INFOPASS to get it all sorted out. Bring both the card and the letter.

My wife also just received her 10y green card! Been a long way to this but we are done until her N-400 if she wishes. We could never have made our way through the USCIS maze (craze) without this site. We received NOT ONE RFE. Could not have done it without everyone on VJ.
