Hi all, I have a friend (of course :)) - who is in the following situation:

1. He's in a long term (almost 18 years) relationship with his USC girlfriend.

2. Is able to telecommute for work (works for a foreign company).

He and his girlfriend have decided to marry, they haven't decided whether to marry inside/outside the USA as yet. Here's the rub, he has managed to spend a number of years in the US, simply by reentering (never overstaying) on his B2. Is this likely to cause major issues when he starts the process of any immigrant visa application for the US?

If he never overstayed then no! I do the same thing, my job is in London fiancé here - i am In and out all the time on my b2. They do sometimes ask questions when they realize how frequently I travel here but I always have proof of my secure job in London. Now our petition is filed it might get more tricky but if you have never violated the terms of your visa I don't see any cause for concern.

August 27th 2012 NVC received petition

Sep 3rd 2012 Received Packet 3 from London Embassy

If he never overstayed then no! I do the same thing, my job is in London fiancé here - i am In and out all the time on my b2. They do sometimes ask questions when they realize how frequently I travel here but I always have proof of my secure job in London. Now our petition is filed it might get more tricky but if you have never violated the terms of your visa I don't see any cause for concern.

Thanks, but do you spend the majority of your time in the USA, this is the worry my friend has. Although he hasn't violated the terms of any visa, he hasn't been using it in the spirit it was issued.

They will, most likely, ask about this at the time of the interview; but if he hasn't done anything wrong, everything should be ok.

IF asked at the time of the interview, all your friend has to do, is tell the truth good.gif IF they don't ask your friend about the long visits, tell your friend NOT to volunteer information.

No problems with it- he never overstayed and they let him in every time. Basically, he just got lucky with the border guards letting him in so often. There is a chance that once they file, they will look at his pattern of visits more closely and may not let him in for another visit for a while. But it will not affect the K1 or CR-1.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

So he's basically been living in USA, working on a laptop from home and I's here majority of time? When he god home, how long would he stay and where to? If he is going home just to return to renew the stamp then maybe he might be better spending more time at home so it doesn't look as fishy... I spend 50/50 here. I'm aware they might refuse me one of these days but now our petition is filed I intend to stay at home a bit more before the big move.

No, if he's always been legally here then he's always been legally here and hasn't done anything improper.
