June 25, 2012, 1302 days in AP, my fiance received a brief letter from the Islamabad Embassy along with his passport saying that our I129F visa petition had expired and was being returned to the USCIS office from which it was originally submitted. I have never heard of a petition expiring and thought that the Embassy would have to make some kind of decision. I thought I'd share in case it is new to anyone else or will be helpful to anyone in the future. We were also told that this can not be appealed (because there was no decision) we will have to reapply.

Oh my goodness, your interview was in 2008... I'm really sorry this has happened to you. I haven't heard of this at all. I'm curious to know what steps you took throughout the AP process and what answers you received from people.

Definitely excessive wow.gif Did you just wait all this time? Did you reach out to anyone for answers and help?

We had my Congressman helping for a little over two years (but he gave up too) and also both Senators. It was actually the Senators office that let us know first. I have been sending to the Embassy my boarding passes and pictures every year I visited and of course inquiring with the Embassy and writing to the Ambassador. But I did not engage any legal council.

Any of the government officials (Congressman and Senators) that helped me were all met with the same response as me. That we are in AP but of course their response was more polite and formal. I actually have one letter from the Embassy where they tell the Congressman that our case did not fall through the cracks and we were not forgotten.

sorry to hear the news, i guess some news is better then no news!

SO what are your thinking about doing now?

We are hoping my finace will be accepted at a European University and we can marry in Europe and start again. Hopefully our case will be handled by the Embassy of the country he is residing. (we don't want to marry in Pakistan and have our small wedding etc. questioned) We can only pray that AP will not be so long and whatever the reason the case officer could not make a decision before their doubts can be cleared up with our marriage and new petition.

I would go ahead and get married in Pakistan. I also had a small wedding with no pics from it and got through with no problems, but I had one thing going for me that I had lived in Pakistan for a while, so had a lot of face time with my husband. It seems that you have had a few trips and this is a good thing showing you have physically been together more than once. In my opinion, the CO's seem to have concerns when people have a small wedding on the USC's first, short visit. This doesn't seem to be the case with you.
