For others who have been reaffirmed at what stage were you asked for further evidence? I am just curious....Did USCIS request evidence or did the Consulate?

I have seen RFE at USCIS, checklist from NVC, and request missing documents from consulate.

What is your specific question?

What is your specific question?

My specific question is in regards to being denied at the interview, USCIS wrote they reaffirmed but when I called today it was reapproved and had already been sent on to the Consulate. I thought I would have to supply evidence to debunk the CO's notes, but no such request. That is why I asked when does this evidence need to be submitted? I just don't understand why I wasn't asked for further evidence as we were denied at the first interview. Maybe I am just confused all the way around about this process, lol.

I think you are still missing several main points to make others understand your situation before they can answer.

what was the reason for denial by consulate at the interview?

what actions consulate took after denial?

Congrats Tracy. That sounds like great news!!!

Call DOS back and ask what day it was returned to the consulate.

Then email the embassy and ask when his interview is and make sure you go and bring alot of evidence

Sometimes when it is sent back USCIS will send you a NOIR/NOID. But id USCIS thinks that your case is good then they just send it back to the embassy and make them interview him again.

Sept 30, 2011 NVC number and IIN received Friday-gotta wait till Monday

Oct 13, 2011 Case Completed- 13 days from receiving case number Took 32 days from NOA2

Nov 30, 2011 Notified of Interview date

January 19, 2012 Interview- 240 days from NOA1

INTERVIEW RESULTS-APPROVED WITH 14 WEEKS AP--but he got his visa in 56 days!!!!!!

I think you are still missing several main points to make others understand your situation before they can answer.

what was the reason for denial by consulate at the interview?

what actions consulate took after denial?

Which evidence they asked to provide?

Reason for denial was the CO wrote my husband entered into relationship for immigration purposes only, any other CO notes were never disclosed to us.

The Consulate sent our case back to NVC and then onto USCIS.

They did not ask for any evidence, I received notice of reaffirmation, then when I called today I was told it had been re approved and sent on to Department of State, called them and they told me it has been forwarded to the Lagos Consulate.

Not through NVC, but directly to the Consulate. No RFE. I am just confused as I was sure we would have to battle the CO's notes to get re approved, considering our red flags and where we are going through.

Thank you! I asked for a sign from God and He sent it BIG time, lol. And I will call DOS tomorrow and ask, thanks for the advice! :)

Tracy how long from the time USCIS received your petition back from the Consulate did it take for them to reaffirm your petition. My husband's interview ending in denial as well. June 15 I got a notice from USCIS that they had received the case back for a request to review. Now I am like you expecting a NOIR and I am gathering lots of information and evidence.

Knowing your timeline will give me a little hope.

Moved from Progress Reports to Process & Procedures.

I thought I would have to supply evidence to debunk the CO's notes, but no such request. That is why I asked when does this evidence need to be submitted? I just don't understand why I wasn't asked for further evidence as we were denied at the first interview. Maybe I am just confused all the way around about this process, lol.

USCIS received the file back and the adjudicator who reviewed the file disagreed with the Consulate's decision and reaffirmed the original approval (i.e. the adjudicator reviewing your file determined it was not necessary to send you an NOIR).

If USCIS reaffirmed your petition approval without sending you a Notice of Intent to Deny giving you an opportunity to submit further evidence and/or explanation, then be prepared to do so at the Consulate.

Facts are cheap...knowing how to use them is precious...

it took 132 days in total from the day they received it back, but they will tell you to give them 180 days. I had a Congressional Inquiry done at 122 days, not sure if that helped my case or not, but am sure God intervened in this! :)

Never received NOIR, got a email and hard copy saying we had been reaffirmed but when I called I was told not reaffirmed but re approved and sent back to the Consulate already.

Can someone help me I received the same letter but I am a bit confused because on June 19 I received a letter from uscis saying that they are reviewing my case and then a minute later they send me another letter saying that my case was reaffirm and was sent to the department of state for visa processing what does this mean I don't understand if the second letter is accurate

Apparently, they completed their review quickly and reaffirmed the petition approval.
