I-864 - recent tax return only or 3 years to avoid RFE?

Hi,

it seems that alot of VJ folks use 3 years of tax return to demonstrate the financial support for the I-864. The reason I ask this is because the IRS website did not seem to take any submission from me, I have tried ordering transcripts for myself (f-1 visa) and my sponsor (USC spouse) about 3 weeks ago, and never received anything in the mail at all. I called the IRS toll free # and they said they would send again.

Has anyone sent only the most recent tax return as a sponsor/joint sponsor and still got approved for AOS without RFE ??

Any advice is appreciated!

On the form, it said last 3 years is optional, so I included only the latest tax return (2011) along with most recent bank statement and 3 pay stubs.

I sure hope they'll accept this kind of deal. I filed 864 last week and kinda wondered myself if it was sufficient.

The instructions say either the most recent year or 3 years. It is your choice.

Quick question on this.... last year I was laid off and didn't work for almost 1/2 the year so my income was right at $17,728 which is well under the $18,900 something minimum. I wasn't able to find a job so I moved to Maryland and this year I will earn well over the minimum and of course the tax year 2010 I was over the minimum as well. I will have to get 2009 as I do not have a copy of those taxes with me, just 2010 and 2011 taxes.

Will we be possibly denied because of 2011 taxes? I can show current earnings/check stubs but worried about last year! Thanks!!

The big reason to send the last 3 is to prove that you've met the requirement (form instructions, page 8) to have filed tax returns for the most recent 3 years. It can also show an earning pattern that may be helpful in some instances.

Why risk the delay that comes from an RFE?

Current income is what counts. Make sure you send in proof of current employment, which shows you over the threshold.

Sorry, i suppose it was unnecessary to mention the car.. I guess it's just a bit staggering how many threads I read here where the I-864 is a legitimate concern. There's a reason they have income requirements...

The guy who just mentioned having BMW's shouldn't immediately after be commenting on all the people for whom the income requirement is a struggle. It's just comes off really bad. (George Bush - like) ;)

But I consider myself "poor" and the income requirement is no issue for me. It's really, really low. So even though I don't drive a BMW or anything close (we are a 1 car family) I also have been shocked at how many people struggle with the income requirement. Not that I don't think poor people shouldn't be with their families. More that I'm surprised so many people make less than 18,000 and are able to survive on it.

Oh, and I sent the most recent tax return and ordered transcripts of the rest, just in case I get asked.
