Good day! I need help guys and I know most of you are knowledgeable in giving the ideas and advice for new member like me.

Okay, I will just tell the story short.. Me and my fiance met personally on May 19, 2010 to be exact. And he went home June 1, 2010 back to US. Then since he was very busy and deal with some important things he didn't had the chance to apply for the fiance visa that time. Then he decide to apply for the papers on November. However, unfortunately he asked assistance from attorney but I guess he just pretend he was (attorney) though. My fiance gave money to apply for the K1 visa. He said it was already sent, and I was waiting a couple of months and he didn't even have a notification. And I start wondering what is happening but he said we just have to wait. I was very patient and trusted him. Time had gone waiting, and my fiance found out that the guy lied. And he didn't tell me about this stuff before, until he finally told me. Since he was worried because of the timeframe that we met within 2years so we can apply for the visa and didn't want to waste our time since he is very busy at work and no idea until when he come back here and visit me again. So he decided to send out the papers overnight. I just want to know are we still in good shape? Thank you! I appreciate your help in advance. Bless you all... :)

You must file within 2 years of meeting. Litely they will allow file day of June 1, 2012. It's probably not considered "filed" until the "Notice Date", which can be 1 or more days after the "Received Date". The notice is when they officially accept the petition, after quick checks of amount of money sent and signitures etc... When was it sent? Personally, my notice day was 1 day after the receive day, but this is not always the case.

Agree with L+T, it would be good to know when he overnighted the package. Assuming the package is accepted, your fiancé should plan to visit you in the next few months to avoid any claims of fraud once you get to the interview since at that point, it will be well over two years since you've seen one another in person.

Sorry to hijack the thread. I am on the same boat, but my fiancee and I met in December 2010. She is under a student scholarship contracts that prohibits her from leaving the country until the return service is complete. The contract expires in November 2012. We just finished our application (I-129F). I visited her last month as well. Should I include both times I met her in person?

1/18/2013 - Married

3/5/2013 - Filed AOS, EAD & AP

3/7/2013 - USCIS Chicago rec'd applications

3/12/2013 - USCIS sends NOA1 email

YES!! You have pleanty of time to file. Be sure to include good evidence of meeting. Photos, Airline Boarding passes, receipts, passport stamps etc...

Technically, you have to have met within two years before filing. However, when people receive RFE for meeting in person, it's the date of when USCIS received the petition that counts. On the NOA1, there are 2 dates; petition receive date, and notice date. You get the best answer once you know the receive date.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)
