Timeline

I do not know if this is the correct place for this but.....I met my Fiance through her sister. Long story short my fiancee has 2 sisters here in US both came on K1 niether stayd married to pettioner. Oldest waited 5 years other waited 2 years. I am worried I have been hustled.......I have not filed AJOS yet and wonder what I need to do to report this. My fiance also has 2 K2 age 8 and 6 that are here and since she arrived the 8 yearold refuses to leave the aunts house and they are already plan on enrolling her in school else where nd her living without us. My fiance has only been here 30 days and I. Have not married her as I am growing supicous of her familys intent. The oldest pettioned the mother who is here hooked up the other sister with a co worker fr a K1 and now me.........what can I do of the k2 that they are letting live else where and also my fiance as I suspect fraud?

Don't file the Adjustment of Status for her. I think that you can call the Fraud hotline too. You can write a letter to USCIS and let them know what you think is going on. How long has she been here? Did you meet her in person here in the U.S. or did you go to her country? I seen that you met her through her sister and I am just wondering how you met her. If you feel that you have been taken, by all means report it.

some possible paths:

Do Nothing

1. Do Not Get Married

2. Her I-94 will expire then

3. yer off the hook

Marry Her

1. Marry her then

2. File the Adjustment of Status Casefile then

3. IF and only IF your fraud suspicions prove to be true then

4. withdraw the I-864, affadavit of support prior to green card issuance and then

5. divorce

There is another path, but I not suggest it unless you are certain she's not defrauding you, and that's to marry, file, stay married, and have a happy life together.

Follow your gut. If you feel something is up, then it probably is. Don't marry her. Let USCIS know you're not marrying her.

11/09/2012 - Appointment for Biometrics
12/08/2012 - EAD and AP Card arrived in mail. No updates to USCIS website.
07/26/2013 - Approved, no interview.

04/30/2015 - Mailed I-751

06/03/2015 - Appointment for Biometrics

02/29/2016 - Approved, no interview.

03/14/2016 - Received 10-year Card

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Not at all, 90 days is given so people can make wedding plans. If they wanted to give people time to get to know each other state side, they would do like Australia and provide 9 months or more to get married using the fiance visa.

Or better yet, give the beneficiary a non adjustable tourist visa once an application for I-129F has been filed so he/she can travel. They already have all the information they need, or ask for more, on both the applicant and beneficiary. ICE can just show up to carry any overstaying beneficiary off and charge the applicant with a felony.

OP - the flip side (the good bits)

the two kids are out of the way at YOUR household right now, so you and yer lass can spend lots of quality time together. I think one can see this to be a big plus, if, indeed, the two of you ARE spending quality time together.

whoops, sorry, this is the only good bit that comes to mind, at the moment. I smell a long-running , perpetuation of fraud with the sisters . Or, maybe, indeed (look into this, soon) this is some cultural thing with family and taking care of the kids. They have more immediate family around, and you need to ease into being the daddy.

I agree with Roger, their appears to be a pattern of activity. The question is did you know this before or just ignore it, either way, it is a personal decision. Do nothing no AOS. Let her stay at family and not at your house. Every time I don't follow my gut i get jammed. Best of luck no matter what you decide, your decision not ours.
