Timeline

That's another scenario, babies having babies. When you have kids young the grandparents esp mothers think you will never be adequate enough in taking care of your baby even when years have passed (trust, I know). So you find at 30 your mother still treats you like a child.

The in-laws seem pretty decent. They are divorced but still

live in California. Husband doesn't call them alot. Sends

an occasional email. Each parent tries to visit every couple

years to visit family in various parts of the country.

Believe me when I say I've been thinking long and hard about these issues long before I posted them for feedback.

I can always turn myself in as an overstayer and request voluntary departure. I have a current passport so the governments wouldn't

need to communicate with each other for travel documents.

I'd hopefully be returned to the state I last held residence in, and start from scratch. The only place to go would be up at that

point.

Last week, we were able to talk with a solicitor about starting the process for me in the UK. He gave us a list of stuff to make

copies of (Like similar stuff to I-130 evidence). He in turn, has an inside contact at the UKBA and is going to ask him to glance

at our information and tell us what my chance of success will be.

I had to include a sincere letter of apology regarding my overstay.

If my chances turn out to be slim or complicated, I'll probably bow out of the situation with a great feeling of relief and head

back home.

Ignoring the fees for moment (you do know how much they are??), that is another issue for you, it doesn't look good reading this link can you apply?

Can you 'switch' if you are already in the UK?

You may be allowed to switch into the category of husband, wife or civil partner if:

you are currently in the UK with permission as a fiance(e) or proposed civil partner, or as the husband, wife, civil partner or unmarried/same-sex partner of a relevant points-based system migrant, and you are still with the same husband, wife or partner;

or

you entered the UK in a different immigration category (for example, as a student), and you have been given permission to live here for a total of more than 6 months since your most recent admission to the UK. For example, you can switch if we gave you a 3-month visa and then permission to remain for 5 months, totalling 8 months. Your current permission must have been given in accordance with the Immigration Rules, not 'exceptionally' (outside the Immigration Rules).

You will not be allowed to switch if:

you have entered or remained in the UK in breach of the immigration laws (for example, by overstaying your visa);

or

your marriage or civil partnership took place after a decision was made to deport or remove you from the UK;

or

you came to the UK as a visitor with permission to stay for 6 months - you must leave the UK and apply from your country of residence

Talk about rock and hard place, I wish you good luck in whatever you decide to do.

I believe it's about £800 for the visa, and so far the solicitor

hasn't charged anything. My husband's work called up the guy for

a favor and that's how we were able to talk to him.

This is why the solicitor asked me to write a sincere heartfelt letter

of apology asking them forgiveness of my overstay and the reasons I

would not be able to return to America for the process (no airfare or

place to live). Then, he's going to hand over the stuff we made copies

of with the letter I wrote, and ask his friend at the Border Agency to

look them over and tell us our chances before we actually apply for real.

That way, we won't waste £800 if we get denied because we'd already know

if we were going to be approved or not.
