As long as he has never overstayed the VWP and has strong ties to his home he can visit while you wait for the petition to go through it's normal loops. It really isn't as bad as it seems , many of us have gone through places where the non USC had not possible route to visit and had to wiat out the entiire mess.

This will not be over quickly. You will not enjoy this.
