Good morning. :-)

I have a question if anyone could give me some guidance my partner and I wish to get married in the usa she's a US citizen I'm from the UK we have a sponsor already for us but we've been told by 2 different people that they got married in the USA then they used a lawyer too do a spouse visa petition and while that was going through there foreign spouse stayed in the USA is that correct could we marry and I stay in the USA while the spouse visa petition is going through or do I have too return to the UK any help would be great thank you david

It is possible to do that, yes.

It also could be fraud.

IF you came to the US on vacation and suddenly decided you can't live without your girlfriend for a second longer and you guys go and get married tomorrow, then yes, you can file for adjustment of status and stay in the States while that is being processed. If it's a simple case, you shouldn't need a lawyer. You can do it yourself. Just read read read this website and the uscis.gov site.

IF you PLAN on coming to the US to get married to your girlfriend, that is fraud. Better pray you don't get caught.

If you plan on coming to the states to marry your girlfriend, I would also plan on going back home and waiting for your visa to be approved.

02/01/2013: Interview scheduled

02/22/2013: Embassy received

03/01/2013: Medical

03/20/2013: Interview - was told the boys would have been approved on the spot if they had pics! Errrr :-(

04/15/2013: DNA test

05/15/2013: Emailed embassy BEGGING them to let boys drop off passports for visa insertion. IT WORKED!!!

05/31/2013: Visa in hand

06/02/2013: POE JFK!!!!!!

David, I agree with what has already been said. Even if you were to get away with it it will cost a lot as you would still have to complete the interview, medical and get the UK police certificate (which costs a lot to be delivered internationally) AND throughout it all you would have to pay a lawyer. It would be a simpler and more appropriate course of action to apply for the fiancée visa as you wouldn't be able to work on your plan anyway.

It's not just as simple as getting a "getting a lawyer" as your whole situation may be looked at as suspicious as you entered the US on the VWP, ultimately it may take even longer for you to get a visa.
