Hi I'm beginning my paper work to file for adjustment of status here in the US.

On Form I-485 application to register permanent residence or adjust status it requires I-94 number and I have read in searches that a copy of I-94 is required for the adjustment of status process.

When I was leaving for the U.S I went through immigration in Ireland where the immigration took my I-94, he than stamped my Business Visa in my passport and signed the date the visa is valid till. He did not hand back the I-94. Is this going to be a problem for me.

When asked for I-94 record can I use a copy of my B1 Stamped and signed by immigration visa ?

Any help with this much appreciated.

You say that you were *leaving* the U.S? You cannot AOS from outside of the U.S.

If you were entering the U.S. you would be *given* an I-94.

There is a pre-clearance screening in Dublin, which helps explain some of this, but I am still confused on the other parts. What I-94 was taken? From when?

I think that's the confusing part in reading your story.

Typically you are given an I-94 on ENTRY to the US...you had one prior to entering?

July 2005 - met my awesome, hot, amazing love in Lousiana.
July 2006 - Married said love and moved to Canada.
June 2011 - Entered US to visit family, decided to stay.
Feb. 2012 - Sent paperwork to Chicago.

May 2012 - Received green card.

Yes in Ireland you have to go through U.S immigration at the airport prior to boarding your flight and this is where the I-94 is filled out and the offer takes this along with your passport. But all I got back was my passport.

Hope I'm explaining this right because coming from Ireland we deal with immigration before entry to the U.S.

You actually have a B1 visa and did not enter on the Visa Waiver Program? If you entered on the Visa Waiver Program you do not get an I-94.

Contact the closest deferred inspection office (usually at an airport) for the CBP http://www.cbp.gov/x...red_inspection/ and advise them of your situation. If you go in person bring your passport and explain what happened. They should issue you an I-94. It appears that the agent in Ireland 'got confused' and forgot to issue one, as you were coming in on a visa rather than the Visa Waiver Program. (They used to issue I-94Ws to those entering on a VWP - don't know if they still do).

They may try to tell you you lost it so be prepared for that. On another thread a Visa Journey member did find out that you can use the proof that you do have (include boarding pass as well) and a written explanation of why you do not have an I-94 and the steps you have taken to get one and submit that as an alternative for the I-94 on the I-485 application.
