Good day!

Situation: We are planning to apply for my AOS, I'm under K3 visa. Since I undergone sputum test in the Philippines before I went here in US, we received a letter from the county for repeat testing where they say it's for free. So we went and did the test etc. and never paid anything. After 2 weeks we received an application for medi-cal from a social worker of the county.

Question:

If we are going to fill out the application is it gonna affect the AOS application?

Are they going to deny our AOS because we did the test for free?

Please educate me about this matter. Thank you very much!

No your AOS will not be denied because you got free sputum testing at the county health clinic.

The reason they sent you the app to apply for Medi-Cal is because you received services from the county.

First of all, you need to qualify for Medi-cal, do you?

Do I qualify for Medi-Cal benefits?

If you are enrolled in one of the following programs, you can get Medi-Cal:

  • SSI/SSP
  • CalWorks (AFDC)
  • Refugee Assistance
  • Foster Care or Adoption Assistance Program
  • In-Home Supportive Services (IHSS)

You can also get Medi-Cal if you are:

  • 65 or older
  • Blind
  • Disabled
  • Under 21
  • Pregnant
  • In a skilled nursing or intermediate care home
  • On refugee status for a limited time, depending how long you have been in the United States
  • A parent or caretaker relative or a child under 21 if:

    The child's parent is deceased or doesn't live with the child, or

    The child's parent is incapacitated, or

    The child's parent is under employed or unemployed

  • Have been screened for breast and/or cervical cancer (Breast and Cervical Cancer Treatment Program)

Contact your local County office for more information or Apply On-line (Not DHCS).

Medi-Cal is Medicaid in California. It is a means tested benefit that a green card holder is not eligible for during the first 5 years of residency.

It would be a problem during AOS to receive Medi-Cal. First, the public charge issue. Second, the US spouse would would be responsible for all MediCal benefits under the I-864.

As long as you don't apply for Medi-Cal, you will be fine.
