Has anyone here filed a W-7 with their tax return because their spouse has not yet been approved for a visa? How did it work out for you?

When we were at NVC last year, we filed a W7 so I could get an ITIN. Went great. Only took about a month from filing to my husband receiving his refund.

Thanks Saylin. Two other VJer's said they were denied a ITIN. I sent in his original passport, birth certificate and our marriage license. I can not understand why they were denied.

Thanks Saylin. Two other VJer's said they were denied a ITIN. I sent in his original passport, birth certificate and our marriage license. I can not understand why they were denied.

blink.gif I've never heard of anyone being denied an ITIN. Did they send in everything they were supposed to?

I am not sure, but they said they were denied.

I know December sounds a bit weird, as it's not tax season then, but we filed the TY2010 (not amended) in December 2011.

Then TY 2011 in Feb 2012.

Lots of W7 forms get filed without the proper documentation. WITH proper documentation, there's no reason to deny an ITIN to the spouse of a US Citizen. Documentation is the key.

I hope he's applied for one already... He's going to need one at NVC (and then later on for the interview).

And you can always amend your taxes once he gets to the US (and gets a SSN) to get a bigger refund.

Oh, local interview.

If you think you'll be denied, then you will. Why not think of approval instead?

There seems to be two issues at least. Did you move after filing the petition. Usually a local interview would be pretty much local. Can you reschedule the "standard interview" at a USCIS office near you? You also mentioned a problem with "his history there". Does he have a criminal record or a previous issue with US immigration?
