DS230 for US consular posts in India (Mumbai or New Delhi)

Hello friends,

My question is very specific to the DS230 process for members who are petitioning for relatives to immigrate from India (The consulate at Mumbai or Embassy at New Delhi) under the IR* category.

My spouse's I-130 has been approved and the file has been forwarded to the NVC. While we await on the acknowledgment from NVC, we wanted to get the paperwork in order for the next steps. In the DS3032 (Choice of Agent), I would like to receive all communications at my US address and would serve as the agent.

My questions are as follows-

1. Does DS230 part I and part II both need to be submitted at NVC?

I am sort of confused looking at some older posts wherein they state that Part I is submitted at the NVC while the Part II is submitted at the consular post/embassy in India. There are others that state that both Part I and Part II need to be submitted at the consular post/embassy in India.

2. What are the supporting documents that need to be submitted with DS230 Part I? and DS230 Part II? Assuming that they need to be sent separately.

I have already sent the following documents to USCIS while filing for I-130: copy of US passport, copy of naturalization certificate, copy of marriage certificate and three letters of affidavit of bonafide marriage.

3. Do I need to resend the documents mentioned above to the NVC along with others that you may suggest?

As far as I know, DS-230 needs to be send whole to NVC (part I and II), but just part I signed by your spouse. Take a look at this very helpful thread, long though but you will find most answers here:

Watch if India is available for electronic processing.

BTW, you need to call NVC after one week of your NOA2 and try to get a case #, after that wait till your spouse receives a DS-3032 through email so she can send an electronic choice of agent through email to NVC. I have been experiencing a bit of delay in my son's case due to an email I sent right after mine and my daughter to them, chosing my husband as our agent, I wasn't supposed to do that to my son because I haven't received his DS-3032 via email yet. So tell her to send the electronic choice of agent just after her DS-3032 is generated in their system.

Once NVC issues you a case number, the beneficiary can e-mail the DS-3032 stating the choice of agent.

DS-230 Part I and II have to be submitted at NVC, with Part I signed.

1. Original/Certified Copy of Marriage Certificate

2. Beneficiary's Original/Certified Copy of Birth Certificate

3. Beneficiary's Police Clearance Certificate from the local Passport office ONLY

4. Beneficiary's Divorce Decree Original (if applicable)

5. Copy of biographic page of beneficiary's passport

6. Two passport photographs of the beneficiary.

Make sure also to include a copy of each of these documents.

3. Do I need to resend the documents mentioned above to the NVC along with others that you may suggest?

No, you do not need to resend any of the documents you've mentioned to the NVC.

BTW, you need to call NVC after one week of your NOA2 and try to get a case #, after that wait till your spouse receives a DS-3032 through email so she can send an electronic choice of agent through email to NVC. By the way, I see on your timeline that your consulate was supposed to be Chennai. From Jan of 2012, all immigration visa interviews that used to be assigned to the Chennai consulate have been moved to the Mumbai consulate. Please change that on your timeline.

By the way, I see on your timeline that your consulate was supposed to be Chennai. From Jan of 2012, all immigration visa interviews that used to be assigned to the Chennai consulate have been moved to the Mumbai consulate. Please change that on your timeline.

Yes, once you receive your case number and the invoice identification number, you'll be asked to provide the petitioner as well as beneficiary's email addresses.

Yeah I saw just now that India is not into the EP, that's why I said WATCH IF...

Anyways, after one week of your NOA2 date, you can either call them and ask them for the case # and give them her email to be input into their system or she can write them an email (following the samples, she will write her USCIS receipt number, assuming she does not have a case # yet, her full name and her date of birth in the subject line) take a look at this guideline:

So she will receive an automated message from NVC and you can give it a few days and start calling to check if her case was input and she can have a case #, it took me 5 days to get mine after they receive my files from USCIS.

One quick question- How did you or your spouse manage to get a Police Clearance Certificate (PCC) from the passport office so soon?

My wife is a resident of Hyderabad, and from what I understand, you need to present the paperwork from the US Consulate/Embassy to even request for a PCC.

What has your (or your spouse's) experience been with this?

Yes, once you receive your case number and the invoice identification number, you'll be asked to provide the petitioner as well as beneficiary's email addresses.

It's quite simple really. Hyderabad is one of the many cities in India that has a passport seva kendra.

Ask your wife to register there and apply for a PCC with the necessary documents, and then go and pick it up. You DO NOT need any sort of paperwork from the consulate.
