i had the same situation but only thing was different is that i had 2yrs-(1 or 2 day) it was almost 2 yrs like 1 day less...but i havent got any reply yet so still hoping..

But here is the situation when you do not meet the requirement. They will NOT look at it when it is filed. You will get an NOA1, they will cash your check. 5, 6, or 7 months pass then you will get an RFE. You will not be able to provide what the RFE asks for. Then you will wait while the make a decision on your RFE and maybe 2 months later you get denied. 7-9 months has been wasted and you start over. Bad idea.

In the case you describe, beating the deadline by 1 or 2 days, they MAY approve it or they MAY ask for more evidence of relationship. even though not normally required, they CAN ask for it. The other option is that the petition gets approvedand the consulate demies the visa. An approved petition does NOT equal an approved visa. High fraud countries like India are far more likely to deny the visa based on a lack of evidence of relationship.

2 years is a long time to not physically meet someone that you intend to marry.

Buy a ticket for one of ye to visit the other, or meet somewhere in-between.

It might cost a lot of money but... well, it's better than doin' the K-1 all over again!

I wonder if anyone may have an answer for this: I have had an on going relationship with my fiance in the Philippines since January 2007. We have a small store over there with an apartment upstairs that she lives in. I am finally getting her papers together and haven't been there since March 21st 2010 due to various reasons. I do talk to her every day on Yahoo (video chat). I know they say you have to meet in person within 2 years of applying for the K1. I really don't want to have to spend $2000 to go there to visit if I don't have to. Has anyone had a situation like this and if so how did they handle it?

You answered your own question.....You're gonna spend $2000. That is your only option besides giving up on the whole deal.

i got approved without meeting that requirement by 2 months. I responsed to my RFE with solid financial reasons and how i made my decision not to visit her prior to submit my petition. however, i did show my ticket and visa for the upcoming trip that i bought before i received the RFE. I will be with her for 2 months this April and May. I do not know what will happen at the interview yet. I hope to be with my fiancee for the interview or at least wait outside. This is my own special case and will not applicable to other. My suggestion is if you could visit your fiancee please do so. it will save you a lot of headaches later.

The requirements ARE the requirements, you HAVE to have met in person within the past two years for the K-1 process. My last flight only cost $1,100.

No. If the RFE is for more proof of meeting in the last 2 years, the meeting must have happened in the 2 years BEFORE you filed the petition. You cannot send in proof of meeting together after the fact. The recent visit would be evidence for the consulate later at your visa interview to prove relationship. It will not work for the petition. The meetings face to face in person had to occur in the 2 years prior to filing your petition.
