Hello All

We are planning to file the petition this month but we have some worries about my husband previous marriage.He had a short marriage from a

filipina and had been divorced for nearly 2 years this April. Their marriage failed because my husband ex just used him for immigration

purpose but he didnt report her he just wanted to get out of the marriage.Does it will raise a red flag on our case? Do we need a lawyer

coz our case is considered a complicated case?

Any comments will be greatly appreciated...

Your husband sponsored his ex-wife from the Philippines, divorced her soon after she entered USA, did not claim or report immigration fraud and is now sponsoring a second individual from the same Country of residence. This is a giant red flag.

I don't see how people are telling you everything will be fine and dandy, because at least to me, it appears you have an uphill battle in front of you.

If doesn't matter how much you love your husband. Word of mouth proves nothing to US immigration. They go by legal facts.

my thoughts to you is that you best start preparing from this moment on and gather as many possible proofs of a bona-fide relationship as possible as well as as many proofs as possible that your husband's ex-wife was at fault and not him.

I am filing a second fiance petition. I filed one 6 years ago and married my fiancee. She ultimately left me after getting her citizenship.

I don't know how this one will go, but I previously posted a question about any impact, and there were a number of people that have gone through it more than once who told me it shouldn't be a problem. Both of mine are Philippines, and some of theirs were as well.

I remembered my husband told me that even tried to save their marriage by consulting to his ex-wife parents back in the Philippines.

those emails would be a proof that its all his ex-wife fault.

I agree with sulhaq because in my case my husband had an Ex-Chinese and used him for visa too. Am telling you it was a horrible waiting times when our Adjustment of status interviewed had no decision on the SPOT and was under Supervisor's review T_T.. We waited for 3 stressful months to have a decision. In your case, bring documents as much as you can because USCIS is all about documents,documents,documents!!! Good idea that your husband saved his email saying that he wanted to work it out. One more thing!!!! Prepare to defend your hubby during CFO interview am telling you they are strict!!! they will be more strict to you specially ur hubby already petioned a Filipina.

Your husband has failed to report to USCIS that he has completed divorce with his ex-wife while she was under conditional greecard period of 2 years. I have not personally seen anyone with similar situation, but I am pretty sure that this will trigger a big red flag. USCIS has all rights to say that your husband has failed to complete his responsibility to report his divorce which occurred during conditional green card period.

I'm too going threw this as well waiting to see what will happen? I was married to a Filipino woman and things just didn't work out we were married just under 2 years i tried to report but got no where with the USICS (guess they had bigger things to worry about?) so i filed and got a divorce that was back in April of last year. My fiancee now is also Filipino totally two different women and my fiancee now has a child (7) i have petition for both and we are at our 4 month mark on April 2nd hope to get our NOA2 soon without a RFE so i will keep you guys posted on what happens to us. All i can say is I'm leaving it in Gods hands because i think everything happens for a reason and i trust in the lord.

Even though we are far from each other right now I know you are close to me in other ways,you are always here in my heart.
