Advance Parole and Death Certificate

My wife just found out today that her father had just passed away in Japan and is hoping to return ASAP.

We filed already for the AoS along with the Advance Parole. We checked the website and see that the Advance Parole was sent to us 8 days ago. We havent received it so we were thinking to just walk into the USCIS and try to get one there, as i have heard this has happened. Also, as i understand, we will need to get a copy of the Death Certificate.This may take several days for the local offices in Japan to produce, then of course it will be emailed.

Will there be any issues with it being in Japanese? Will official translations be needed since the officer that she goes to probably will not be able to read it.

Any advice concerning this directly or any other that i may not see is greatly appreciated.

If AP was mailed to you 8 days ago it should be to you any day. Did you also apply for the EAD? If you did, the AP will be included in the EAD card. If not, it will be a paper document.

You should have your AP before you get any death certificate documents. Best wishes.

If AP was mailed to you 8 days ago it should be to you any day. Did you also apply for the EAD? If you did, the AP will be included in the EAD card. If not, it will be a paper document.

You should have your AP before you get any death certificate documents. Best wishes.

Harpa,yes, we applied for the EAD along with the AoS too, as she was not able to get an EAD at her Port of Entry. Concerning the EAD being sent with the AP, the USCIS website noted that only her AP had been sent, nothing was mentioned about the EAD request being accepted or anything being included with the AP

I guess we can only hope it comes soon, but we still need the death certificate, and hopefully it being in Japanese will be acceptable.

Why do you need the death certificate?

They need it to prove that it is an emergency, rather than just someone claiming so.

We were able to get a meeting with a supervisor at USCIS yesterday. She told us to get a death certificate. Later that night, my mother in law was able to scan and email the death certificate to us. We returned to the USCIS today and were able to get an emergency drop-in meeting with an immigration officer. She said that they could reissue another one which would require the full fee again, but she found out that the original would be paired with her EAD which was sent on the 12th (2 days ago). The officer told us that since the Advance Parole had been accepted and processed my wife could return to Japan without it, and when i receive it, i can mail it to her in Japan before she returns to the US. I originally expected that the AP would need to be stamped on her way out of the US and would create a problem when reviewed when trying to return to the US but apparently this does not happen. After returning home from the USCIS i checked the mail, and there it was, and EAD and AP. Ok, now to make travel plans.

Oh, and as far as translations for the Death Certificate, they will accept translations from anybody, as long as they sign it. So in our case, my wife was able to make a translation, and sign it, which was acceptable.

You don't need to prove an emergency to use AP. You can just use her AP. It's in your hand now so no issue. Again, I am sorry for your loss.
