Hi,

Brief description of my case:

Entered US in 2003 on J-1.

Stayed in US until 2010 got married and left to UK.

Followed Consular Processing steps.

Attended Interview at the London embassy last week.

Officer requested some more paperwork (for example my sponsor was born in Germany and i need to prove he is US citizen)

but also my old passport was requested with previous visa.

I assume that officer wants to establish if i had unlawful presence in US and if i'm even allowed to go back without the ban.

My port of entry stamp in my old passport (and the one i had on I-94) has no expiration date, no D/S (Duration of Stay), no class as a matter of fact it has only date of entry.

What do you think might happen?

Were you stamped d/s for duration of stay? If not your chances of getting a 10 year ban are 100%. The only way you not get a ban is if it had d/s and you were never contacted by uscis or asked to appear in front of a immigration judge.

hello...

you have 10 years ban, if you stay in usa after your J-1 visa expired ( you was illegal in usa). you can file i-601 waiver thru us embassy, if you marrige is bona fide to us citizen.

Just a question, were you asked if you had ever been unlawfully present in the US? Either on paper or in person? If so, what did you answer?
