You have gotten some great advice here but it seems to me that you are still a little confused.

Here is something to make the process easy on you:

If you marry in Korea you will return to the US alone and apply for a CR1 Spousal Visa.

For any visa you will need a sponsor (USC) that makes enough money to support their household and your wife.

or

You can file for a K1 fiance' visa as long as you have been to visit her within the last 2 years.

The guides for all your choices are very helpful if you read them carefully. Try to get to the basics first.

April 14, 2014 - VISA Received

April 18, 2014 - Flight to USA

July 11, 2014 - MARRIED!!!!

August ,2015 - AOS finally filed ;-)

August ,2015 - RFE

September 2015 - Returned RFE information

November ,2015 - EAD Approved

November ,2015 - EAD Received

December ,2015- AOS Approved

December ,2015- 2 year Green Card Received

(you are allowed to a co-sponsor, but I think it has to be an USC as well).

For any visa you will need a sponsor (USC) that makes enough money to support their household and your wife.

They do not have to be a USC. A co-sponsor can be any US citizen or legal permanent resident that resides in the US.

Hi,

I hope you are a little less confused now.

Incase you are still confused I can try and make it even simpler.

1) Get married in Korea.

2) Return home to the US alone and file the CR-1.

- You will do paper work, have interviews, probably have to have a co-sponsor because you are not earning enough.

3) Once CR-1 is approved your spouse can enter the US and will be a LPR.

OR

1) File for a K1 visa.

- You will do paper work, have interviews, probably have to have a co-sponsor because you are not earning enough.

2) Visit Korea and DO NOT get married, finalise your engagement, have an engagement party, whatever, just DO NOT get married.

3) Wait for the k1 visa to be approved and then your fiance will be able to come to the US and you can get married.

- You need to get married within 90 days of her entering the US.

- You will then need to adjust your new wife's status to LPR.

If you marry your fiance in July 2012 you will NOT be able to bring her back to the US with you. She may be able to come on a Visa waiver program or on tourist visa but she would have to return.

I feel you best option is the K1 visa. If you send off you I129-f before the end of march, if all things go well your fiance could be in the country by the end of the year and legally.

You can have a party for all your family and friends in Korea and then just have a small wedding in the US.

If you HAVE to get married in Korea in July then your only option is the CR-1.
