i am already confuse . . will my husband need to file K4 form for my son . . but he is included in the petition . . please enlighten me on this . .

Your son will derive his immigration benefits as a result of your approved petition, if he is included in the petition.

I'm sure Darnell will fill you in about the K-3, which is basically a dead visa option.

usually, all of the docs the foreign spouse filled out for the K-3, to submit to the embassy IV unit?

fill out a new set, for the child, paying the fee.

USCitizen not file K-3 and K-4 visa application - that's on the foreign spouse.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Why folks are answering in the context of the unobtainable K3 and K4 visas, is beyond me. Unless your husband filed an I-130 for you and another one for your son, he needs to file the I-130 for your son immediately.

Yes, if the K3 and K4 were actually obtainable (like they were in the last decade) your husband could wait to file the son's I-130 until after you were both here and adjusting status. Even that is a bad idea, because it would delay the son's status adjustment.

Forget about the K3. Make plans for CR1 and CR2 visas.

Your timeline says NOTHING about having filed an I-129F after filing the I-130. Did your husband file one or two I-130 petitions?

Why file the I-129F? The I-129F will be administratively closed and the I-130 will be processed for the purpose of a IR-1 or CR-1 visa. At least it was free so your husband only lost his time.

Specifically, did you husband file an I-130 petition for your son? The I-129F petition will not result in any visa but it may delay the visa you DO get.

Based on that you should change your "Filed For" from K-3 to IR/CR-1...

Have lots of patience, the wait for the NOA2 will be several months.
