The good news is that you should probably hear soon. I wrote my Congressman last week, after the processing time passed the 5 month mark, which at the time was reported as the average processing time. It seems that despite the recent update to Aug. 2, people in mid to late August are getting their approval.

To write your Congressman or Senator, you should first go to his/her website to download the appropriate release form and get the office contact information. You should also call or contact the office first so they are aware of your case and will assign someone from the office to handle your case. You then need to submit the release form, copies of all the materials you submitted to USCIS, and likely a cover letter to your Congressman/Senator. I'll include the cover letter I wrote below, but you'll need to adapt it to your purposes. No promises that it's the best or anything.

Sept 9, 2011: NOA1

March 16, 2012: NOA2

April 10, 2012: NVC Case Number Assigned, AOS Invoice Received

April 17, 2012: IV Bill invoiced, paid

April 19, 2012: IV package sent

April 20, 2012: Checklist for AOS asking for letter of employment, response sent

May 1, 2012: Appointment Letter Received (for May 23rd)

July 15, 2012: New Appointment letter Received

August 1, 2012: Interview, Approved

Wow, that's a very elaborate letter indeed.

We wrote a simpler one. Unable to attach file, so just copying and pasting contents here.

From place and date

Your name and address

To

Congressman’s name and address

Dear Congressman ______,

Sub: USCIS receipt number WAC11xxxxxxxxxfor Alien Relative

I had filed a petition for my wife, Mrs. xxx, with a notice ofapplication received from USCIS dated 08/19/2011. We are approaching six months since the dateof application, and thus far have not received any word from CSC with regardsto the status of the said petition. Weare well over CSC’s normal processing time of five months.

May I take this opportunity to request you to kindly look into thismatter. Any help in this regard would begreatly appreciated.

Thanking you,

Yours sincerely,

Your name and signature

Mind you, four days after the letter to the congressman, we got our reply as well as our approval

I can't argue with a four day turn-around. I think the main thing is just to give them the basic information and introduce yourself a little to explain why they should help you. A lot of the release forms seem to include a space in which you can explain what you are requesting on that page, in which case you could probably even skip the cover letter.

Oh, I'm so sorry. I wasn't trying to undermine your letter. Frankly, I liked your letter much better than ours. When I mentioned that we got our approval in four days, my state of mind was that indeed we got lucky despite sending a short mail.

I do hope you understand where I'm coming from. God bless and may you get your approval soon too.

Point One: The timelines that are published on USCIS site are "Guidelines" not set in stone or have any legal bearing. If the street in front of their office is being repaired and they cannot get in their offices - all work will get backlogged. So the 5 month guideline is not something I would hold on to.

Point Two: A request to an elected official is also no guarantee that the case will move forward over regular work flow. The exceptions are "humanitarian grounds", health emergency, etc. Unfortunately too many use those as a reason why their case must be worked on before others. Does not work like that and one can say something which may not be true and create more problems.

A Congressional inquiry will help only if the guideline timeline has exceeded by a substantial time. Currently it appears (no one really has any concrete information or data - it is pure speculation) that CSC is running 7-9 months for any number of reasons. Think of it like this: too many petititons, too many poorly organized cases, too many issues pointing to more closer scrutiny and the list goes on.

Best Advice (I am a lay person trying to help my fellow humans (smile)) Have patience, be ready to supply any additional information requested, get your paperwork for NVC ready, if your sponsor information is weak then work on getting another sponsor in case you need one, and if you believe in God Almighty then pray sincerely that your case is treated with fairness and moves forward.

Many Blessings. And lots of good old fashioned Luck.
