My fiance did K1 4 years ago. And he is divorced now, the benefactor has now 10 year green card. Is there anything he has to do before filing another K1 visa?

Is your fiancee a US citizen? It's unclear from your post if he is the US citizen who filed the original K-1 or the beneficiary who has a 10 years green card. (A beneficiary is someone who receives a benefit. A benefactor is someone who gives a benefit. Your usage of "benefactor" having a 10 years green card is confusing.)

Assuming your fiance is a U.S. citizen, he can file a I-129F petition, there is nothing he has to do with regards to that first petition before filing a new I-129F petition naming you as the alien fiancee.

He has to be a US citizen before he could file for K1 visa.

Assuming the OP's Fiance is the US Citizen who sponsored a K-1 4 years ago.

The US Citizen will need to include their previous spouse on the Affidavit of Support (counts towards their household size) but that's it really.

The OP's post is unclear to me - "My fiance did K1 4 year ago" could mean he was the US citizen petitioner or the K-1 visa holder. Which is it?

These are my assumptions when in responded to the OP's question:

OP is a filipina.

Some filipinas writes in english but still think in filipino language.

Sometimes, expect incomplete information and the receiver just fill the gaps on the information...

I could be wrong but I dont have to worry coz i have another assumption that OP will eventually respond to clarify the first post. :-)

sorry for the confusing question. The Petitioner is US citizen, benefactor was a Filipina. Petitioner filed a K1 visa in 2008 and a 10 year green card. Question: Is there anything the Petitioner has to do before filing another K1 visa for a Filipina beneficiary?.

Summary of your data:

Petitioner: US Citizen

Petitioner Background: Filed K1 in 2008. Presently Divorced. Ex-wife has 10 year greencard

Your Question: Is there anything the Petitioner has to do before filing another K1 visa for a Filipina beneficiary?.

My answer: He could file for another K1 as long as he has all the required documents (i.e. divorce paper)

My personal advise for you. Get to know each other pretty well.

Agreed, but don't forget my previous reply...

He will have to include his ex in the household count for the Affidavit of Support as he's still on the hook financially for her until she naturalizes, works 40 quarters, abandons her LPR Status or dies.

Also, double agree with the bold part of the quote...

Bob,

Make sense regarding counting x household count, for AOS.
