Hi, I came with a K-1 Visa and I have married within 3 months. We have filed the AOS and EAD as soon as we married. My EAD will be arrived within 30 days, but now I need my Social Security for Tax return. My I-94 is already expired for 2 months and I came to the States last September? How should I apply the Social Security Number as soon as possible please? I am in Chicago and there is a SSA office, should I go directly?

No social until you get a aos 797 letter, FYI everyone on a K1 needs to apply 2 weeks after arrival in the USA for their social. Attempt to get a TIN for now. http://www.gtsec.com/taxes/forms/formw7.asp

You could have received one immediately on arrival but did not. Because for some strange reason you did not apply for one. This is another reason I suggest you get an SSN before you unpack your suitcase.

You do not need the SSN for taxes at all, nor do you need an ITIN. Simply write "pending" in the place for the SSN on the tax form and do a paper return MAILED to the IRS and they will MAIL your refund check to you. If you wish you can go to the SS office and they will give you a letter stating you are not currently eligible for an SSN but it is not needed.

If you want to file electronically, you MUST have an SSN and in order to get that you will need an EAD or green card. It then takes the IRS computer 2-4 weeks to catch up with the SS computers and get your number logged in. Until then it will reject any attempt to file electronically. So you are looking at receipt of EAD + SSN time + 4 weeks+ 10 days minimum for electronic tax refund.

Looking at what you have written I am guessing that getting a paper return in the mail tomorrow would be the fastest way for you to get a refund and I assume that is what you are seeking.

SSN is not required for AOS. You will not get an RFE for an SSN. No need for an ITIN. Chill out. File a peper return.

Have your spouse file for an extension, and file return once you receive your EAD and can get a SSN.

its mid feb... no extension yet required for two months. if ead is truly 30 days away, ssn should be issued before tax day

If you have received notification that your EAD has been approved and will arrive within 30 days, it will probably arrive in about 1 to 2 weeks after the approval date, so you may not be waiting that long.

However it will still take a couple of weeks to get the SS card even after you have the EAD in hand.
