Will I be able to get another fiancée or a spousal visa again?

HELLO EVERYBODY!!!

Someone please advice,

Will I be able to get another fiancée or a spousal visa

again?

Here is my past immigration history:

The first time I applied for fiancée visa was in June

2002 for a Russian woman; it was approved by the INS

but it was stopped/refused by the US embassy in Moscow

because she had pending multiple visa applications by

several other men.

So I abandoned the case.

The second time, I applied for the fiancée visa for

another Russian woman in June 2003; it was approved by

the INS but it was stalled at the US embassy in Moscow

because of my previous fiancée visa application;

therefore it was pending for consular/administrative

review.

Tired of the long waiting, in April 2004 I traveled to

Cyprus with my fiancée, got married there in Nicosia

and soon after I applied for the spousal visa directly

at the US embassy there in Nicosia. She finally got

the immigrant visa and came to America.

Soon after I got back in the USA, I sent a fax to the

US embassy in Moscow to stop/cancel the pending

fiancée visa.

Everything went fine to this point.

But unfortunately in America my wife was not

comfortable, not happy and unable to adjust to the new

life. Therefore in July 2005 she left and went back to

Russia.

Finally I got divorced in January 2006.

I want to try again, just one more time, with a very

nice Ukrainian woman I met on my summer vacation;

Will it be possible to apply for another fiancée visa again and

get passed through the new IMBRA law?

Will she be able to receive the fiancée visa at the US

embassy in Kiev or will she be put on hold?

Perhaps it will be faster and surer to get the visa if

I get married in Kiev and apply directly at the US

embassy there in Kiev for a spousal/immigrant visa

if DCF is possible?

Or is there any other way to easily/faster/surely

bring her here in the USA?

I think you might want to consult with a good immigration lawyer at this point. Fair or not, I'd say there will be flags going up all over the place for USCIS and the DOS if you try again...

Out of curiousity, what makes you think this one is going to be different? Sounds like you've had some disastrous luck with Eastern European women...

January 2004: Met Laurent at the Bibliothèque nationale in Paris

February 2004: We became an actual couple

January 29th, 2006: I left France to return to the United States--AWFUL to say goodbye!

June 2006: Finally convinced Laurent that a K-1 visa would be more time-effective than trying to get an H-1

August 1st, 2006: The K-1 petition is finally in the mail and on its way to Nebraska...WooHoooo!! And yes, I remembered to attach the check! :-)

August 3rd, 2006: USPS online tracking shows that my petition (sent certified) was received at the NSC at 5:05am

August 14th, 2006: NOA1 received USPS!! (I-129F recv'd at CSC: 8/4; NOA date: 8/10; last touched: 8/11)

October 2nd, 2006: I MISTAKENLY thought we had an approval...False alarm...Back to waiting...

October 3rd, 2006: TOUCHED!!

October 4th, 2006: REALLY AND TRULY APPROVED!!! Email notification lists 10/3 as the NOA2 date.

Later that same day: TOUCHED...AGAIN! Hope that means I'm in a cozy box and moving to NVC this week...

October 10th, 2006: Received official NOA2 via snail mail.

October 19th, 2006: Case received at NVC!! AWESOME!!

October 20th, 2006: Case forwarded to Paris!! DHL says two shipments were headed that way. Must be in there somewhere...

October 27th, 2006: Received official receipt letter from NVC via USPS.

Well that is quite the past...lol

I do think it is going to raise some red flags, but one thing I have learned from experience is to address all possible red flags when you file the I-129F or I-130. It could possibly slow down the approval of this petition, but if it isn't addressed there then you run the risk of the consulate sending back the petition for review and recomment revocation of the petition. Write them a letter explaining the past situations, and make sure to send plenty of proof that this relationship is real. The USCIS won't know about the past situations, but the consulate will.

They did that to us, and it has been over a year now since my husbands interview and he is still not with me. A few extra months at the USCIS is better than this!

BTW, our petition was reaffirmed and is on its way back to the consulate, so even if you do end up in our shoes it doesn't necessarily mean the end. True love can conquer all.

It's really a colorful history. :unsure:

I dont think this time would be easy for u to apply her to come to USA.

Because of ur applying record, u do need a lawyer.

Hi!

Look, if all that happened with you and you didn't do anything against your ex espouse ... don't fear the IMBRA process!

You will be able to explain the situation at some point...even if takes longer than other times!!!

You are free to call the immigration and ask them...

Be free from your past... of course it will bring consequences, but God can make everything new!!!

I REALLY hope that GOd help you on this journey and give you a nice family! Everybody desires it!!!

I agree. If it were me I'd be taking some time out to take a long hard look at why this happens. In other words, give the visa-fiance'-marriage thing a rest, and find out what's causing you to pick the wrong women. Maybe they are fine women, just not a match for you and your life.

Joseph, considering your past history, and especially considering the scrutiny you underwent with your second petition, I do believe it will be in your best interest to consult with a good immigration attorny. It looks like you have a number of large hurdles to cross.

Stalled at the embassy in Moscow AFTER INS approval? Even though you had a previous petition approved, I was under the impression that if INS approved it (after reviewing the history) that shouldnt matter at the embassy level.

Your story is very intriguing indeed.

I agree with the previous posters, find a savvy immigration attorney with experience with multiple petition cases. I wish you best of luck

Just the fact that your first fiancee had several petitions from different men raises a huge flag as to whether you were just trying to help a woman to get across the pond and her a green card or you weren't aware of this. Then your second petition was also considered suspicious, and you went ahead and married outside of US and got her here on a spouse visa. So in fact this time would be your 4th time petitioning for a immigrant visa based on marriage so yes, you'll have a tough bumpy ride and should consult with an attorney.

I think this might be problematic. How experienced can any attorney be with the new IMBRA restrictions and waiver requirements? Since they have only been around since March, the first cases requiring waivers are just now being tested and adjudicated.

Remember the filing limitations apply only to K1 and not K3. I would think K3 would be the path of least resistance. With K1 you would have to request a waiver for multiple filings over the numerical limit. Ever considered looking outside Russia and the former eastern bloc countries? Just a thought.

JOSEPH has potential problems in two areas. The one that you mention - getting the IMBRA waiver from USCIS to ge the petition approved - is indeed new.

The other potential problem - convincing the visa officer at the consulate that the relationship is bona fide given the circumstances - has been around for a long time and any number of attornies have had experience dealing with it.
