Hi VJ's i am new here, just wanna ask something...my fiancee he been sick this month of November and his Doctors and specialist they telling my fiancee that he got cancer and they say's also he wont be around longer :( ! i want to know if this case cause any problem of my petition.my petition been approved last Nov.22 and now i am waiting letter from US embassy manila..need help please!!! thanks

If he passes before your visa is approved it will be cancelled. If they have approved your visa but you are unable to get there and marry before he does then you're out of luck and will need to return back to the Philippines.

If you are able to get there and marry you will be able to apply to AOS as a widow.

From a non-immigration standpoint you have more trouble. It's important to note though that he will need to make sure he has a Will (if they will deem him mentally able to make changes after you're married) or at least make sure his affairs are in order because depending on the state it's not guaranteed that you will get everything (or anything). If someone dies intestate (without a Will) it is usually split between spouse and surviving siblings/cousins/parents etc, and dying after marriage and before changing your Will is sometimes deemed intestate because marriage often cancels out any Will made before the marriage. I also don't know how good your relationship is with your in-laws but they could contest any Will stating that you weren't married long enough, or that you took advantage of a sick man, or whatever and even if they don't win, it can eat up a lot of funds fighting it. You will be fighting an uphill battle if you want to try and claim and life insurance, or superannuation or anything like that and he needs to add you ASAP. Same with adding your name to any bank accounts. If he has a mortgage on the house (bank loan) you will have to pay out the mortgage (or switch it to your name) before they will let you remain there (after he passes). Your name wouldn't be on the Deed (most likely) so there's things to figure out there as well. It might be totally fine but you should make sure to have money for a return flight "just in case".

if you're asking whether the embassy might deny you a visa based on his being sick, answer is no. however, if the inevitable happens even after your mnl# arrives (the go signal to apply for a visa), then everything will definitely change because all of the processes are based on his approved petition for you.

still, from what i remember, you and/or he can write the nvc for a visa waiver based on humanitarian reasons which allows you to go to the US for a fixed short stay if you can present proof of his medical condition. go to travel.gov and you will find more info on that.

hopefully, more JVs will advise you on your situation =)

If he passes before your visa is approved it will be cancelled. If they have approved your visa but you are unable to get there and marry before he does then you're out of luck and will need to return back to the Philippines.

Thanks for advice... i have good relationship with his family and they wanted to comeover soon and they promise me nothing to worry if ever happen my fiancee die they taking care of me.

We are figure out now til i got my manila case# hope i get my letter soon...he getting worse everyday its really hard for me knowing my fiancee suffering pain without me his side :huh: ...

I waited to see other replies, sorry for this. But, now I will suggest.

You have a NOA2 and are awaiting your MNL #. Leave it at the. Let the Interview happen and there is NO NEED to bring a Medical Condition as Cancer of the Petitioner into the subject whatsoever. (Manila is going to send the MNL# to the Petitioner or Attorney and not the beneficiary. )

The MNL# should be given by NVC and the Petitioner has access to that number for your Medical, Visa Fees, ETC. (About 3 weeks after NOA2 Approval)

I don't think an Expidite would be in your favor due to I see No Savings in time to speed your Arrival. (Your far into the process)

Also, you don't get diagnosed with Cancer and just die immediately, its a slow death and can take years but not in all cases but some recover with treatment. I don't think A Diagnosis of Cancer is a reason to worry about your Petition. Medical Records of the Petitioner are Confidential and not Public even to USCIS.

So go foward with your petition as it is. Get your MNL# , get your Medical, Fees, ETC and don't this this Cancer thing affect you.

There is No Need to Disclose the Personal Medical Reasons/Documents of the USC in anyway. It does not affect your Petition.

Yeah your right he promise me for fight the cancer because he wanted to full filled his promises..I believe when two people love each other enough, anything can happen as long as they believe in each other. he get strength from me and God.

I know as much as the previous writers (which is basically nothing) so I would like to suggest don't think that they can't deny you if they think he is petitioning you to come take care of him in his dying days. I actually read this somewhere on a legal web site I think. It is possible that if your case of bonified relationship is not strong enough that him having cancer might result in a denial. It all depends on the how the CO views your file. My point is, don't disclose this. Nobody will ask about it because nobody knows but you and his family.

You might think that shedding tears of your greif would result in compassion but you don't know. The best thing to do is keep your mouth shut about it because the fact that he has cancer likely would not benefit you in any way in getting your visa and could hurt you so keep it private and good luck.
