I'm not surprised. There's nothing wrong with me or what I said, but whenever I post, it's like Pavlov's dogs run out to drool on queue. If that's how the usual suspects want to spend their time, it's no skin off my teeth. In fact, having so much control over guys I don't even know is rather comical.

The Health Department will pay for this since all employees are agents for them and, as such, are liable. Any repercussions are something else.

Thus, I would say, the department supervisor representing the agency gave him his assignments of work..... You violate you fired........ It's interesting to note that the doctor who interfered with the supervisor's instructions didn't intervene to save this nurse's job. The nurse was on the job for less than 3 months, from September to December 1, 2010. If he was on probation, he's got even less protection in an at-will state, such as Michigan, than he would have had if he had been able to show a long-term pattern of performance on his part.

He's filed on the basis of gender discrimination, a protected class. Considering that it is common practice to allow patients to discriminate on the basis of gender, the onus is on the clinic to show that he treated women against their will. Still, unless there is a glaring act against public policy, it's very difficult to win against a government agency for grounds other than negligence.

Why would the doctor do anything? You seem to lack any links or case law for your analysis. This case is likely going to turn on Title VII of the Civil Rights Act of 1964 and the Elliott-Larsen Civil Rights Act enacted by the State of Michigan in 1977. The civil suit will probably be settled long before the EEOC gets to court, plaintiff will likely get a right to sue letter from the EEOC (sounds like he already has) and away we go.
