hi all!

new to the forum, would like to do a little intro of my background

came to the US with F1 visa in 2007

my F1 status ended in september this year and i got married with my wife USC in september

my question to you is,

my wife had filed AOS for her ex-husband a few years ago and it was denined by the US embassy in china.

after one year due to the long distance, they she went back to china and got divoce with him last year, and i have the divoce paper translated in english by myself as its originally in chinese

will her record of previous filling AOS for her ex effect our new AOS?

we are gathering all the paper works and about to file our package in a few weeks.

just want to clear things up before we file our package.

Her OAS was denied before so they might question your marriage with more consideration. One more thing, your status expired same time with your marriage so this might be a red flag as well. You guys have to be ready for a tough journey coming. Good luck.

What was the stated reason for the previous denial?

Currently on valid H1B expiring Feb 2012... Cutting it CLOSE with EAD card expected 01.18-24.12...

Met Summer 2005

Started dating seriously Summer 2006

Married September 2008

Procrastinated, enjoyed life with hubby 2009 - 2011

actually her previous I130 for her ex was approved, but his Visa was denied by the American consulate in China during the interview due to the lack of prove of them being husband and wife. because he was living in china and my wife is here in US

for our case, we are married and we are now living in the same house with joined bank account, same cell phone contract and same car insurance policy with her whole family...this should be enought prove for our marriage i think?

is there anything i should look out for before we send in our package??

I think you have to consider and be prepared to answer what they did to continue pursuing the petition. If it was easily abandoned then the IO may intensifier your process. People who are in love don't just let it go after one try. They find other avenues. I know my husband would never let it go (nor I) till we were together some how.

I suspect they will grill her/you on her previous marriage to re-gauge its authenticity then grill you again to see if the current marriage is real.

I think you should both be very careful when handling this... If you are truly in love, this will just be a bump in the road but you will get approved because you won't give up on each other....

AoS in always done in the United States, not in China.

Your marriage will carry a red flag based on the previous petition, the fact that your wife casually abandoned it, and the timing. You can hope for the best but should be prepared to have your relationship scrutinized.
