My fiance and I were engaged last year July 2010, We filed in December 2 2010. I called May 5 2011 to have our application expedited and we received the notice that our application has been put on hold due to background checks. This was in May now it is October and they still have us on hold. Should I go ahead and get a lawyer or will I just be waisting my money by now? Also when I sent in our application they sent me my first NOA and on it they had her country of orgin as of unknown. So I called and they said they had fixed that, but they didn't. So I am just wondering what the next step is. My fiance is getting uneasy and is requesting I get a lawyer right now. So any advice?

After the 5 months some people get their congressman to try speed things up and sometimes it works. Talking to a lawyer for consultation wouldnt hurt either. This is a long time to wait sorry to hear this! More people with experience using congressmen may wish to chime in here?

One thing you should not be doing is sitting around hoping for the best. You can either contact your local congressperson or senator and enlist his help. Getting a lawyer won't hurt either, but contacting your local representative won't cost you anything. The processing time is 5 months and background check usually takes less than 6 months. You have been waiting for a long time. You need to get into their throats.

You have been waiting for a long time. You need to get into their throats.

Do not sit there and wait the process to be completed. Get your senator, lawyer anything you can think of, get the specific thing they suspect in your case, get the answers for them. Ask them how you can help them provide the answers they need through the congress or lawyer. If i were you I would use both of them, but will start from the lawyer, then the Senator, then your case will have a weight.. and the ball will be on their side, because now you have prove something you do not even know about.
