Hi All,

We are now closer to the interview date and still not sure about what to fill in at No. 9 question in the I134.

Question is: Have you previously submitted an Affidavit of Support?

Here is the situation: My fiance has been divorced since 2007, she was married to someone holding a working visa in 2005 and after the wedding she mostly did all the paper works and asked him to sign. Now, he is trying very hard to remember those that he signed but not sure if it was an Affidavit of Support (I864). But I think that it may be is, because his ex-wife was probably trying to adjust her status from a work visa to a permanent resident. I asked him about submission of tax returns, pay slip etc - he said no but those were all in the computer so his ex-wife probably downloaded those that she needed. I wish he could remember though.

Is it safe to write in the ex-wife's name to answer the question? We don't want the embassy to think we are concealing any information, which may be material to the case.

i would say its safe to assume he did sign one for her, and to list it accordingly. remember his income will have to meet the threshold for your household plus 1 (her) unless she's a citizen now.

2009/06/19 - 1st NOA 1 (I-129F)

2009/10/07 - NOA 2

2010/01/11 - interview; result - approved

2010/01/18 - received passport with visa in the mail

2010/02/05 - embassy calls and asked to return visa for a "correction"

2010/02/09 - fiance returns passport with visa to embassy

2010/03/09 - embassy tells us we are in "administrative review"

2010/09/07 - fiance receives passport back with canceled visa and letter; our petition has been returned to USCIS

2010/11/08 - 2nd NOA 1 (I-129F ROUND 2)

2011/04/19 - service request response - 6 months additional extensive background checks

2011/08/22 - 2nd NOA 2

2011/10/04 - interview

2011/10/20 - visa received

2011/11/04 - POE

2011/11/25 - legal marriage

2012/07/21 - wedding with family and friends!!

About the income, which one does he declare as gross amount? Is it last year's, as supported by tax returns or must we base on recent pay slips? It has changed a lot but still above the 125% poverty level.
