I am the Australian Fiancee. My fiance is the US Citizen.

He just recently graduated from college, and hasn't got much income to show for the last couple of years, or this year. He was in Australia for 3 months of it also. He was working for a different company since he returned, but didn't like it and quit 2 weeks ago (right before we received NOA2 >.< He said he thought he'd have enough time to establish another job - he's going back to the company that he worked for before he came to Australia)

Up until 2 weeks ago, his parents were willing to cosponsor, but I don't know what has happened in the last 2 weeks as they have withdrawn their support.

He has a friend that he is going to ask to cosponsor, but I'm not sure how that is going to turn out. He seems rather positive about it, but that may just be to stop me worrying.

My question is ... I am friends with another US citizen, one that he (my fiance) doesn't know very well. Can I ask my friend to cosponsor us (me?) or is this questionable because my fiance doesn't have a relationship with him? (My friend is married, I've known him for years, he and my fiance have talked ... but they don't really know each other, he is more my friend, than my fiances'.

Or maybe his parents will change their mind again :( I really don't know what is going on there.

ANY US citizen or Permanent Resident can co-sponsor as long as the consulate allows it.

Is there a reason your fiance cannot support you? That should probably be addressed first since you will not be able to work for some months after arrival (3-6 months usually) you will have a lot of expenses (more than $1000 just to file the AOS) and you cannot expect all these people you are going to will actually pay your living expenses, right?

Yes, The NOA2 is already approved and there is no deffinate Sponsor. It is all guess work. Parents, changed their minds, He has a friend I dont know I have a friend he don't know. Being a Co-Sponsor is a serious issue. The Economy is Rough but making $11.00 an hour to meet Income requirements should be obtainable. Not practicing what I don't preach. I'm looking for a $11.00 an hour job now. ($20.00 an hour don't matter at this time anymore) My case is already in Manila. I don't rely on a Co-Sponsor or even ask. How important is the rest of your life and how important is this to you. The Petitioner much REACH DOWN and try to succeed like I'm trying as well. Soon you may find yourself with a letter from the Embassey to schedule your appointment and find out like me you will have to schedule a delay if they approve it. Caution: They make that Decision. Wish you Best.

He is starting a new job soon, but he hasn't a history, so to speak. He is sure that he can support me, just hasn't got the evidence - tax returns (w2?). And as he is starting a *new* job (albiet with an employer that he worked for a year ago, in the same capacity though) .. but it is new, so it doesn't count for much?

No,I don't expect these people to pay my living expenses ... I do have some savings, so it wouldn't come down to that, although from what I read my financial situation doesn't matter. Whatever does come up, I'm sure that the money I have in the bank would cover general & emergencies if it came to that, although Eric doesn't think that it will be required, definitely at least until I can get work authorization.

He needs to contact the employer he is returning to and ask for a letter stating as much information as possible such as he used to work there and will be returning, the amount he will be getting paid, what his position is etc. It's not full proof and I am not saying you won't still need a co-sponsor but it MAY fly. It would be even better if you could send in at least one pay stub from the job.

Hopefully someone will call me out on this if I am wrong..But if it comes down to it and you need more time to find a co-sponsor or to have your husband establish more time at the position he will be entering you could just file with a letter from the employer stating what his income will be and have your husband fill out the affidavit and they would send an RFE if they need more information or more support. That just buys you time though.

He has to have filed tax returns for the past two years even if they are not enough to support you they would still be good evidence to support that he does have the ability to work. MAYBE a letter explaining the reasons why he has such little income would help such as he was attending college and has now graduated and has obtained a full time job and here is the letter from his employer to prove it.
