I-130 Application Request for more Evidence‏

Hi everyone.

Well, I just got an email from USCI. They ask us about more evidences for my relationship. I would like know if this is a typical process,I mean, If there is someone else who has received the same email.

Does someone can give me some advices??. We have emails, skype calls, letters, phone calls, photos, etc but I am still little worried about this.

What have you already sent with the petition.... the things you listed - skype logs emails, photos etc?

Did you send proof of having met in the last two years? Plane tickets, boarding passes, passport stamps etc?

USCIS

30 Nov 2010 - Sent I-130 to Chicago

1 Dec 2010 - I-130 received at Chicago

18 Apr 2011 - APPROVED!! NOA2 text and email

NVC

29 Apr 2011 - Case entered into the system/Case number assigned; Medical Exam in Sydney

30 Apr 2011 - Police Check Application sent

2 May 2011 - Called NVC and got Invoice ID number

3 May 2011 - Sent DS-3032 email

4 May 2011 - Received email reply from NVC for DS-3032; Received Medical Exam results

5 May 2011 - AOS invoiced and paid

7 May 2011 - AOS package sent; IV invoiced and paid

9 May 2011 - AOS package delivered to NVC according to tracking

20 May 2011 - RFE for missing IV package....still waiting on Police Certificate!

24 May 2011 - Received Police Certificate after 25 days (so much for 7-10!); IV package sent

27 May 2011 - IV package delivered according to tracking

8 Jun 2011 - RFE for original marriage certificate; requested supervisor review since we KNOW it was in the package!

30 Jun 2011 - SIF and CC - FINALLY!!!!

13 Jul 2011 - Interview date assigned! Scheduled for August 9th @ 10am

9 Aug 2011 - Interview - APPROVED!!!!!!!!!!!!!!!!!!!!!!!!!

12 Aug 2011 - Visa in hand

24 Aug 2011 - POE @ LAX

What exactly was asked for in the RFE? Can't help you in any meaningful way without having the same information you have.

Oh wow.

You have 2 I-797-C receipt notices - one for the I-130, another for the I-129F

Check the receipt numbers against the RFE notice.

WHICH PETITION was hit on the RFE?

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

I received a I-797E form. I can attache it if you wish. I have not sent anything yet. The attorney said that it is a normal process but like I said, I am little worried about this.

This is what I refer to as an extensive RFE. We see these more often when the beneficiary is coming from the Middle East or North Africa but are seeing more lately. Do the best you can to respond to each item they ask for. They know not everybody will have everything.

Wow that's a lot of additional evidence they're asking for!

What was provided with the original I-130 petition?

I'm asking because I thought we sent a light packet and were approved. All we included was Our Birth Certificates, Marriage Certificate, Bio Page from my Passport (copy), Boarding pass stubs from my flight & 2 joint back accounts.

The fact that a small percentage of petitioners are getting these extensive RFE requests is not a reason for everybody to start sending in all these things. They are isolated cases. Not sure if some or all are randomly selected but I expect most have some red flags prompting the RFE.

I agree but has it been established that this "small percentage of petitioners" has sent the same or similar evidence with their initial petition?

Similar minimal information, yes, but few have joint bank accounts. What I'm trying to say is that there's really no way to avoid these extensive RFE's. They are NOT the result of sending too little evidence with the initial petition. The cases are "selected" either randomly or based on specific circumstances, not based on having sent too little evidence. In short, there's not a "solution" for preventing them.
