IR2 help visa approve or denied???

Hi everyone, i hope somebody can give me some ideas to what is happening...

I am IR2 petition by my mother before i reached 21 yrs old. I am now 27 yrs old and i have one child but never got married. I had my intervier yesterday july 8, 2011. i have submitted all documents in the checklist no question w/ that but during inetrview consul is asking for the Birth cert of my daughter issued by NSO so i have given her the BC on hand but consul is asking for the second page of it, but i double check there is no second page...right before the final interview consul asked me to wait for my name to be called.and when it was my turn, i was told that they need a new copy of the birth cert of my daughter which will be requested to the branch office where they (member of embassy ) will be picking up...they never they never told me if my visa was approve or denied.they did not give me back my documents including my passport, all they told me is that they will contact me as soon as they will receive the birth cert and will call / mail me, bcoz they will be reviewing my case.

can somebody please tell me what is happening? is my visa approve or denied?

Sounds like you are in AP. Your visa is not approved or denied it is sitting in limbo until they get the documents they need. After they get the documents and review them then they will make a decision and notify you.

are they calling me for this? or should i be calling them? :-( my daughter is not included in the petition though...is that still necessary that it will affect my visa? why havent they given my documents and passport?

As per my knowledge I could see that there is no problem with your visa. Once you submit the new Birth certificate they will approve it. Actually only if you send the Birth certifcate your visa is approved until then it is in pending as they need BC to approve it

i did actually give a copy of BC of my daughter but they were asking for a new copy..i dont know why what is the difference with it...

First, since you are over 21 you are not IR-2 category.

Is your Mom a US Citizen or just LPR? If you mom naturalized before you turned 21 then you could have been issued an IR-2 before your 21st birthday but once you're 21 you then get put into Family Preference categories. Your are an F1 if your Mom is a US Citizen or an F2B is she's a LPR.

I'll assume you're female since you didn't mention it. They probably want the 2nd page (back side) of your daughter's birth certificate because that's where the biological father would sign to acknowledge paternity of an illegitimate child which would support your contention that you are still single despite having a child. They did ask for your CENOMAR, right?

I guess they are not satisfied with the BC given. May be you need to reapply a new BC...

They want to see the back side for the reasons I've already stated.

i am from the Philippines.and yes she is an illigetimate child, and the father was not recognized in the BC he did not signed anything on the BC.yes you are correct they were looking for the second page..basically there is a second page but when i checked the issuing office since there is no information in the second page or the page is blank it was not included...they advised me to request BC in the preferred branch of the issuing office and the embassy representative will be the one to pick it up, and they will have a review on the status of my visa...

At first my step dad was the one who petition me but i was not able to process it...now my mother was the one who petition me.before i reached 21 yrs old she is already a US citizen.

They did not give back my passport and documents..what does it mean? The issuing office which is NSO informed that the embassy will be picking it up this coming friday and after that my visa will be subject for review...does it mean my visa was denied...for long will this process take for me to be able to know the exact results

That your Passport was kept is a good indication of approval, they just want to confirm something. As you now qualify for a F-Class Visa they may just want to be sure if your relationship to your daughter and her ability to accompany you if you want. You do understand you can bring her with you since you don't currently qualify for an IR Visa, right?

Children of applicants with family-based petitions (F category) may derive immigration benefits from the same petition provided that they are single and under 21. Such children are called “derivatives” for purposes of immigration. Only biological or legally-adopted children are entitled to derivative status. A non-orphan adopted child must have been legally adopted before the age of 16 and must have been in the physical and legal custody of the adoptive parent for at least two years.<br style="border-top-width: 0px; border-right-width: 0px; border-bottom-width: 0px; border-left-width: 0px; border-style: initial; border-color: initial; list-style-type: none; list-style-position: initial; list-style-image: initial; margin-top: 0px; margin-right: 0px; margin-bottom: 0px; margin-left: 0px; padding-top: 0px; padding-right: 0px; padding-bottom: 0px; padding-left: 0px; ">A child born after a petition was filed and approved may be registered or added on to the petition as a derivative. The principal applicant needs to submit the child’s birth certificate printed on NSO paper either to the NVC or to the Embassy and pay the corresponding visa processing fee for each additional derivative.

2004 or 2005 i just gave birth to my child and that was the time my petition was process, i just dont know the exact detail to why my petition was delayed when my daughter was included in the application of visa...i was thinking now, my visa will be denied bcoz of my daughter's lack of proof of documents again same as what happen before.if i may look both sides, what if they were not able to find the exact information that they were looking for in the birth cert of my daughter will that mean my application will be denied?

also, since the name of the father of my daughter is not stated or reflected in her birth cert will that be a problem? do i need other documents aside from the birth cert that i requested to prove that she is illigetimate child? and do you have any idea what is the usual time frame for me to know the result if my visa is approve or denied??
