Hello every one please help me here...

this is the situation My mom who petitioned her un married daughter and she required to fill the Affidavit Support but she never work in US nor claim Tax return.I am a US citizen and work with sufficent income.I figure i can be her joint sponser but which form do i need to fill just I-864 or I-864A or both. My mom lives with me.

1. If i we fill I-864 what does i need to put for Incame return for my mom?

2.If i fill 864A in part one do i put my name or mom name?

Do you claim your mom as a dependent on your taxes? Do you have a spouse? Children?

Likely it's better that mom and you both complete an I-864. With mom having no income the adjudicating officer will want an clear picture of your household. The I-864 will give this.

unemployed and include the date of last work. SINCE she became a LPR. if she filed no taxes.. a letter explaining why.

or you can be a joint sponsor but not necessary if you live in the same house

Yes i have a spouse and one child my spouse dont work. and I have file my mom as dependantin 2010 tax income.

Now the Question i have is..

1. on the form I864 filling this for my mom as sponser what do i answer for # 23 (My current individual income) and # 24 (My current Household income) my mom didnt work so dont have any income and the househould is mine so can i put my household income then?

Mom's information is her individual information. From what you've stated her income is zero. If she does not have a spouse then her household income is zero.

Your I-864 will show a household of 4 (you, spouse, child, mom) plus the intending immigrant for a total of 5. All of your income is listed on your individual I-864.

You're a qualifying relative living in the same household. On that basis you can file an I-864A. There are a couple of advantages to the I-864A. First, it allows the primary sponsor and household member to combine income in order to help the primary sponsor qualify - neither the primary sponsor nor the household member need to be fully qualified on their own. Normally, it would seem like this advantage is moot if the primary sponsor has no income, but there is still an additional advantage to the I-864A - the household member doesn't have to declare their own household size. However, the household member will be considered part of the primary sponsor's household.

First, you fill out the I-864A. Check box 8.c, and then check the "Son or daughter" box. Fill out the income and assets section on page 2. The primary sponsor, your mom, fills out part 2 on page 3 of the I-864A, and signs on line 14. You complete part 3 on page 3, and sign on line 16. You both have to sign the I-864A because it's a contract between the primary sponsor and the household member, unlike the I-864 which is a contract between a sponsor and the US government.

Now, your mom fills out the I-864. On line 21.a she enters "1" for the sponsored immigrant. On line 21.g she enters "1" for you - the I-864A household member. If she doesn't have any other dependents then that's it - the total in line 21.h is "3".

She should check box 22.d and enter the date since she's been unemployed. If she's never worked in the US then enter the "US residence since" date from her green card. Enter "0" for her current annual income on line 23. Enter "0" on line 24.a. In section 24.b she should list your name, relationship "son", and your income from line 10 on the I-864A. Line 24.c should be the sum of your income and hers - since hers is zero then line 24.c will be your income only. Check box 24.d.

She shouldn't check any of the boxes in section 25. She'll need to provide a letter explaining why she hasn't filed a tax return in the past three years. Not working and having no income is a valid reason not to file.

The assets section is self-explanatory, so I won't go into it.

You'll need to provide proof that you're a US citizen, proof of your family relationship with your mother, and proof that you live in the same household.

My 2 cents.....

Jim, it's been noted here on VJ in the past that when a primary sponsor with zero income secures a joint sponsor to supply 100% of the sponsorship the CO has requested an I-864 to obtain the full disclosure / clarity ( household size ) that the I-864 supplies where the I-864A does not.

We all know there is no way to predict what a CO may, or may not request. But, in light of the fact that people are looking to avoid RFE's and delays I would suggest using the I-864 for both the petitioning sponsor as well as the joint sponsor. It can't hurt (assuming the person has sufficient income to meet the requirement).

Jim, it's been noted here on VJ in the past that when a primary sponsor with zero income secures a joint sponsor to supply 100% of the sponsorship the CO has requested an I-864 to obtain the full disclosure / clarity ( household size ) that the I-864 supplies where the I-864A does not.

The I-864A is attached to an I-864 of the principal sponsor. The two forms give the CO a complete picture of household size and financial status. The household member does need to prove the relationship to the principal applicant (such as birth certificate) and immigration/citizen status. Other than that (which can trigger an RFE if not provided), it is much wiser to go for the household member than a joint sponsor. The financial need is covered by the family. And true, no one can predict what the CO may say or require.

To the OP: You can also request a certificate of non-filing (free) from IRS for your mom. It will show your mom has a clearance from IRS. Report her income as zero and write 'NEVER' where it asks the last time worked.

I called NVC today and talked with one of the agent and they told me i have to fill the form as joint sponser with my mom not as a house member (I864 and I-864A). What should i do start from? and i Asked what form to fill they said they cant tell me that but all they told is i have to fill joint sponser since my is dependent on me.

Whats a Cert of non-filing - is it a form that any individual can fill - what if a PR is not working - can they request this to prove that they did not need to file tax returns? Any link to the form?

Any US resident can request his/her IRS records - even if they have never filed for a tax return. The record will show the tax information or lack of. Verification of Non-filing can be requested using form 4506-T (Request for Transcript of Tax Return). It is a multi-purpose form. Your mother has to mark option (7) - Verification of Non-filing. You can request your record for the last three years. Search the form in www.irs.gov, fill it out and sign and mail it to your local IRS office.
