Hello,

I am filling out I-864 for spouse and step daughter who are living abroad(I-130 petition filed seperately). Due to income guideline, my brother is co-sponsoring them. I am confused filling out part 3, question 8. As the petitioner, do I check the question 8 yes box on the I-864 for my spouse? If so, then on part 5, question 21-a, the answer is 1. Again question 21-c should also be 1. Am I not counting my wife twice or should I not answer part 3 at all? Also, do I answer question 21-d as 1 for my step daughter as I am supporting them oversease?

Also, I called the NVC, they could not help regarding this.

Second question is that, when asked, the NVC rep informed me that I don't have to send the W-2s, pay stubs, etc from my job, and, since I am self employed and have a buisness, I still don't need to send the 1099s because I am sending IRS Tax Transcripts. My friend disagrees. Please help as I am confused!!

Yours is a different situation then ours is so I'm not sure how to answer your questions about the , but if you go to the "Example Forms" link above and look at the I-864, your questions may be answered.

Example Forms

Tax transcripts are the best and enough to satisfy the requirement of tax forms, so don't worry about it. :no: If you have any doubt, doesn't hurt to have ready your 1040 and any supporting documentation you have.

Thanks, ELW! I have looked at the example and still remained confused prior to posting here. The example didn't mention whether it was filled out for the spouse or someone else. Assuming it was for the spouse, then, was not the question number "21-C" answered incorrectly?

Hello fwr2011,

As ELW answered to your second question; IRS Tax Transcript should suffice as it is coming from the horses mouth. For some cases where people don't have the transcripts from IRS, sends the tax forms (1099 or 1040, or whatnot) and they do tend to send W2, paystubs to make their point more solid. For NVC, it never hurts to send more than what they are asking for than losing some time for an RFE.

For question 1, I will use my own rationale and will not dare to give you an expert opinion: on Question 8 and 9, you are adding your wife and your children’s (step or not), however for 21c and d, you do need to add those numbers again. I just checked my AOS and noticed that I checked "YES" on question 8, had "1" for question 10, and still put 1 for 21c (21a had "1" from line 10 as well). Now that means I did count it twice as the principal immigrant was my wife, but it did pass through the NVC without any issues.

I wish I could give you a more knowledgeable answer!!!!

My suggestion, talk to someone who went through similar experience and spend few more days to see if someone provides their expert view and then you can your own sense of judgement. Good luck
