WOW i have a family memeber that Work for the IRS

as a director

advice in myy case head of house hold because i have a son in COlombia w. SS# and I been w, full custody of my 10 year old baby girl.

Cant file marry with out ITN Number for your wife that is to late to get and Should not file single however if no kids involve you can file singel and amend your reutn later you will get like 400 dollars extra .

If question just explain that to CO . That should not be and Issue.

IRS Publication 501-Definitions of Status Chinapetitioner is right if the OP fits all three criteria listed under head of household, otherwise Eric-Pris and Magical are correct. Google this above in the search bar , there was quite the spirited and thorough discussion on this in April. Some CO's will look at your filing status sideways if you filed single. This may prompt more questions or just a head shake. Best of luck OP!

Amend your taxes. Won't be too hard. File as married filing separately and you should be ok. The IRS advices to not file married filing jointly if your spouse has at some point during the year been a nonimmigrant since you would have to agree to get taxed on worldwide income (your spouse and yours together which is probably not advantageous for you). P.S. I have not gone through what you are at the moment but as far as dealing with the taxes -Don't Worry :} This is fixable.

For which country's consulates have you seen the "single" status become a problem?

From what I have read directly, Guangzhou.

While I have not seen this issue specifically discussed from people's experiences with Lagos, Casablanca, Ho Chi Minh City, and Cairo; I would imagine this being an issue in those places.

You could have applied for a tax ID number. I would write a letter stating why you did not file married. After you get a social security number you can file an amended return as married and if owed money they will send you a refund

I am also in the same situation. My wife is from Singapore and I am from Chicago,IL U.S. I filed as single. My tax preparer didn't say it would be a big deal if I filed as single. We got married Dec. 18, 2010 in Singapore and I filed for taxes this Jan. 24, 2011 in the U.S. Just a little bit over a month after we got married. Did it or does it matter that I didn't file as married? Do you know if the U.S. Embassy in Singapore is going to make a big deal out of it? Does any body have experience with this situation dealing with the US Embassy in Singapore? Should I go amend my tax return as well or is it to late for that? Any help will be welcomed.

I think we do too. We got married on Jan 22, 2011, my husband filed his 2010 taxes as single last Feb. Do u think this will cause problem also?

you really should revise the tax return and apply for her ITIN. Claiming her as dependent can only help your refund and her chances as interview. If you do this, make sure you get a certified copy of it before sending it out. It took IRS 4 months to do my refund and the lawyer wanted certified copies. I just got the refund after sending the paperwork in on 17th of February. The form to send in is W-7 for ITIN.

Were you married in 2010? If so, then filing single will likely be a problem in the eyes of a CO. I have seen posts from people who filed single even though they were married and their spouse was denied a visa.

I filed single and went through the immigration process with no problems whatsoever. Don't listen to the people who try to scare you into amending your taxes and all that B.S.

What's done is done. I did the same with no consequences. My wife was prepared, if asked to indicate I would be filing an amended return once she and her daughter arrived in the USA. She wasn't asked. If your spouse is asked, I would make sure she is similarly prepared. You can amend a return in Turbo Tax but cannot file electronically without the needed ITIN or SSN.

I believe since he was single all of 2010 then the filing status was correct, hopefully you'll be filing jointly next year!
