Soon I'm filing the petition I-130 for my 2 bro's and sis in India....problem is...my one brother recently got married...just a bit confused, that Do I have to file petition of my brother's spouse too??? or he's going to file whenever he will become the US citizen so than he can file papers for his wife....Is there any guidelines regarding this situation????.....

pls help this confused fella...thanks

You file one petition for each of your brothers and your sister - a total of 3 petitions. For the married brother, as long as you list his family members in section C, question 17, then they will be eligible to apply for derivative visas based on his approved petition. You'll have to submit affidavits of support when each petition reaches the NVC with income sufficient to support everyone who applies for a visa.

05/01/2013 - Removal of Conditions - APPROVED!

Jim is correct, the wife (and any kids born during the waiting period) will be derrivatives. If you cannot afford to financially sponsor all of them, you can choose to only get the brother a visa, and then when he is over here and working, he can sponsor his wife and any kids himself.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
