Hi Ewok,

I think you can help me with this one. I got my visa through K1 and have now my conditional status. I have a daughter left in the PI. She's 16. She was not included in my I129 petition but I put her name with my adjustment of status. I would like to know what form will I use to petition her? Can my husband petition her instead of me to make it faster? If I will petition her, when was the best possible time? I will really appreciate your answer with this. Thanks

Your husband can file a I-130 for your daughter as long as the step-parent relationship begain before the childs 18th birthday.. it will be much quicker for him to file than for you..

Hi! My mother is a US citizen who filed a petition for me. I was married when she filed an application. We were asked to submit annulment decision to change my status which we did to Homeland Security. A case number was already sent to her but I haven't received my copy. I checked my status and I was told of my married name and F1 category. Will it hasten the process if we make sure that my status has changed to single child of a US citizen? And how long should I still wait?

The F1 category is for US citizens to petition for an unmarried child over the age of 21. You have already been moved to the F1 category. If you legally changed your name after your annulment, you need to inform the NVC or USCIS to change that. Otherwise, there is nothing else you can do to speed up the process.

1. I was wondering if you could help i am thinking about bringing my parents over from UK who are both retired to live in the US ( I am US citizen ) i know it will take approx 6-12months , but does anybody have any idea how it works for Medical coverage ???

2. Also we have just did the biometrics to remove the condition of my wife's green card - how long before they send a new updated one ??

3. I have also had the first part of my brothers I-130 approved and it says they will now get in touch for biometrics ,is there any way to speed the process up through a lawyer or so as i am doing it myself and i know they say it takes approx 10yrs ? ( he is in UK )

Lots of Questions - Any advice is appreciated

Your parents will not qualify for Social Security or Medicare. They will have to work in the US for 40 quarters (at least 10 years) or become US citizens to qualify. In the meantime, it would be private health insurance which will run $500 and up per person.

There is nothing a lawyer can do to speed up the process. It's at least ten years for most people. For Filipinos, it's 23 years.

Hi aaron2020 i got a question. My wife is now a us citizen and would like to file the i-130 for both her parents to move here to the united states. Is it after they have been here 5 years the parents can become us citizens? Then they would be able to file an i-130 for their son (her brother) and he would be eligible to immigrate to the US. This whole process would take about 7 years or so by the time the brother would be here.

I'm not concerned about the medical insurance for the parents as i would take care of all that.

Her parents are eligible to become US citizens after 5 years. They will need to file for citizenship which can take anywhere from 6-12 months, this is from the time they file to oath ceremony. Then one of them would need to file an I-130 for their son and the amount of time it would take his for visa would depend on his age and status. If he's under 18 years of age it would be about 12 months. If he's over 18 and unmarried, it would take about 6½ years. And if he's over 18 and married, it would take about 9 years.

My mother-in-law is here on a tourist visa. My wife won't be eligible to petition for her to come here/stay here for about 9 months. I noticed in the USCIS Fac Guide that there are cases where she might remain here while waiting for her petition. She is 80 years old and I don't like to think of her traveling 15 hours by her self back to Tashkent and then making another 15 hour plus trip back here. What are the chances of her being able to stay here until we can file her petition?

Hi I'm sending in my petition for my parents. But I have a quick question for the I-130. 1.) Should I put my A# in question #10? 2.) On question #14 it ask about being my lawful permanent residency, on the date and place of my admission and on question 14b. If I attain my LPR in marriage or not. Here's the thing I already Naturalize, so am a US citizen. Am just confuse because of course when I arrived here I was first a LPR before I turn US citizen. Should I still answer #14 & 14b with the old info of my LPR before or not, (and just right N/A on it) since I'm a US citizen now? TIA! :)

Thanks, About 14b..when I become a LPR before it was through marriage then I naturalize. So should I answer YES? Will that confuse that answer for 14 which is N/A? Or should I put NO bec I'm a citizen now? That's why I'm so confuse with this forms bec they worded their forms very tricky. I know to use common sense but my mind is fighting around it because I want to file this petition correctly to avoid any RFE. Thanks again... :)
