Yeah you are right about that. I don't think this guy is a poster boy for my philosophy. I started thinking along these lines with the johannes mehserle trial.

It sounds like maybe he had some sort of pyschotic fantasy and being in that situation gave him licence to act upon it.

back in the day shooting at a fleeing felon was acceptable. police may still do so in some areas. shooting a guy who is already unconscious and on the ground has never been acceptable, except in extremely unusual circumstances.

FYI, most states allow a person to shoot in defense of self and others for the purpose of eliminating an immediate threat of "heinous crimes against the body". this means that you can shoot someone who is in process of or has stated intent and immediate means to rape, murder, mutilate, incapacitate, or permanently injure. to stay within the limits of the law you must stop shooting once the immediate threat has been eliminated.
