Hey there everyone! First off thank you for looking at this post even if you don't respond. I appreciate it.



I am in preparation of starting to fill out the I-129f, and getting all the documents needed so that my boyfriend from Australia and I can get married in the U.S. But.. I am kind of confused on this whole process. I am young, 21 years old, and I hope that doesn't affect the outcome of all this. I am not going to file any of this until next year until he visits again for the second time.. I have not been to Australia, due to personal and family issues to where I can not travel abroad at this time, but will that make a difference? He will have been here for a total of 4 months before I send this out for us to try and get married. Also the I-129f is kind of confusing.. After question 10 pops up wondering how I am a u.s. citizen; it says Parents and then have you obtained a certificate of citizenship in your name? What is this for?? I don't understand... Also, where we intend to live? Do I put down my fathers address since I live with him? and then send in a change of address once we are married cause we plan to move to another state??

* Just make sure you have a job and your income is above poverty line.

* Another requirement is that you have met in person at least once during the last two years.

* Are you born and raise in the US? Are your parents American? If so, no need to answer those questions. You just need to submit your BC along with documents needed when filing for K1.

You don't necessarily need to have been to his country.... you just need to have proof that you have met at least once within the last 2 years prior to your petition. The best evidence is boarding passes, hotel bookings showing both names, photos of you together, especially at family events with other family members. Photos are considered secondary evidence, but good to have. Later you need to show evidence of ongoing relationship so it is good to collect phone bills (which aren't so popular these days) copies of emails, letters, cards etc.

If you plan to live at your father's address initially, then you should list that address. You need to answer all questions and not leave gaps or they will send you an RFE (request for evidence), which can delay the process.

It becomes clearer if you keep in touch with this site and learn from other peoples experience on their Visa journey and post any questions if you are unsure. Best of luck.

Mar 2011 - After 5mths denied for lost docs - Attempts to follow up failed. Mar 18 2012 - I-129F sent - No sign of NOA1 but they have banked the check...Jul 24 - Update - USCIS has located our file
Infopass Apt - they sorted through everything - our 2011 and 2012 file keep getting mixed up - getting us a Case# (still waiting) Dec- Infopass Appt- expecting to get a case # in about a week ..Still no Case number

Mar 2013 Infopass - advised file was in a box somewhere,and it would be quicker for us to refile. Life gets in the way... New petition submitted July 2014 .

Also the I-129f is kind of confusing.. After question 10 pops up wondering how I am a u.s. citizen; it says Parents and then have you obtained a certificate of citizenship in your name? What is this for?? I don't understand... Also, where we intend to live? Do I put down my fathers address since I live with him? and then send in a change of address once we are married cause we plan to move to another state??

I was also curious about the citizenship part. I'm born citizen with parents, etc all citizens, but I am unsure about this part on the I-129F Question10:

Give number of certificate, date and place it was issued. Do I fill in N/A or NONE or blank? Not a fan of leaving anything blank...

Have you obtained a certificate of citizenship in your name? Do I check "NO"... I paranoid about anything being blank!

If "Yes," give certificate number, date and place it was issued Same question again, N/A, NONE or blank?

Again, I was born here, have a birth certificate etc...

Question 10: If you were born in the US then check "Birth in the US", and leave the other boxes blank. If you were naturalized then check "Naturalization" and write your certificate number in the box beneath. If you were born outside the US, but acquired citizenship by having at least one US citizen parent, then check "Parents", and then check either "yes" or "no" if you have obtained a certificate of citizenship. If you check "yes" then provide the certificate number in the box below.

Don't worry about leaving stuff blank in this section. The answers are mutually exclusive. If you check either "Birth", "Naturalization", or "Parents" then you've answered the question.

State or country: If an address is in the US then enter the state. If it's in a foreign country then enter the country.

I guess I'm hung up on the "certificate of citizenship"... There's no number on the birth certificate that I would use in this section, correct? Because I don't have a certificate of citizenship as I was born here- a birth certificate can't be another form of a certificate of citizenship, right?

My minds spinning with all this, just want to finally print of this one form :bonk:

If you were born in the U.S you just need to send your birth certificate with your petition. If you became a Citizen through Naturalization your Naturalization Certificate and so on...

Good luck on your K-1 journey. :thumbs: You just need to be sure you have all evidence you need to prevent a RFE later.

If you check that you are a citizen by birth in the US, then you stop there. The number is only for naturalized citizens.

This is the best advice for you right now as you are not in a rush to file. Read read read :thumbs:

I will confirm that whoever visits who, (doesn't matter as long as you meet in person) make sure you keep the boarding passes to and from. This is an important piece of evidence that will be needed when you do file. This is a 2 step process. The first is the I-129F application which you the petitioner files on behalf of the beneficiary (your fiance). The requirements are outlined in that link. The biggest being that you have met in person within the last 2 years of filing date and can submit evidence to prove that claim. Boarding passes, hotel receipts, copies of passport stamps(primary evidence) then comes the pics of you 2 together. Photos are considered secondary and only help to establish the primary evidence. Then once that is approved (around 5 months or so currently depending on service center), it allows the beneficiary to apply for the actual K1 Visa. For that interview you will need other documentation as well as proof of an ongoing bona fide relationship.

But, as I said, you have time to read all the wonderful information from the link that was giving to you.

Well actually he would be the provider.. he is a programmer.. and makes good money.. to where I am trying to go to school.. So I won't be making that much money since I am young.. so i dk what to doa bout that

You will need a co-sponsor. No way around that (well other than you making 125% above poverty level, but you said you are not making that much money). Must be a US Citizen also. His salary will not be considered as he will be abandoning that job and coming to US. Once I-129F is approved, when the K1 is being applied for, an affidavit of support (Form I-134) will have to be submitted (along with other forms, but don't want to bombard you with all that yet). That information can also be found on VJ website.
