Fiancee is running away, while she is on a K1 visa.

She used the K1 visa to come here to the U.S. Then she left me before we got married to be with another man she meet online. As the petitioner what are my responsibilities? If she gets in trouble in some way, do I also be in trouble? I am still liable for her? How about if she is hospitalized? Am I liable to pay her medical bills?

If I were you, I would send a formal request to the USCIS to officially withdraw the petition. In this request, I would explain exactly what transpired, which would be your rationale for withdrawing the petition. Include a copy of the NOA2 when sending in your request. Once you've reported this to the USCIS, you are no longer responsible for her based on the circumstances you mentioned. Hopefully, other VJ members can comment on this if I missed something.

Timeline

Report the incident to the USCIS in writing and make it clear you are withdrawing the petition based on the incident.

Keep everything documented, if you have her passport number or copy of passport from time you filed for the K1 send that to ICE and report her as visa fraud.

She cannot adjust her status without leaving the country and as soon as she leaves the country she will have a ban for re-entry. Next time she tries to apply for any visa your report will be there on ICE file of fraud and that should take care of the issue.

I'd say if you haven't gotten married, her K-1 will expire anyway. She has to marry you within 90 days. If she doesn't. FAIL on her part.

She could get booted at anytime.

But I agree with previous poster. Get it formally withdrawn.

You should be ok.

Wow Sorry to hear this, i suppose you actually flew to China and met her. I dont know what i would do in your situation and feel bad you had to go through this. Was there any indication she wasnt interested in you and only interested in coming to the U.S? Thankfully you will be the one to come out of this unscathed in the long run and she will be screwed for her actions! Good luck to you, wish you the best!

Wow. I would definitely let USCIS know just so it is flagged if she tries anything (else) underhanded like faking a marriage certificate or I-864.

You are safe from any problems. It is her that will live under constant threat of deportation from here on out. She obviously doesn't understand the terms of the K-1 visa as she will forever be unable to adjust status from within the US through marriage to anyone but you and will accumulate out of status time beyond her 90 days. Be glad that she didn't understand this and split before you had married and filed AOS (and the I-864) on her behalf.

Absolutely report her and get everything on record before she tries to file a false VAWA claim. Not sure if she can get away with that since you haven't gotten married yet, but do everything you can to protect yourself. Notify any accounts that she might have access to, change any locks she had keys for (even if she was just in your home for a few days). If it is an option, I would even change your phone number. If she is going to contact you make it be in writing so you have records of everything. First and foremost you need to protect yourself now.

Timeline

As others said, IMMIDIATELY report to USCIS to PROTECT YOU before she files claims to against you, or comes back to you for marriage after she realizes the consequences of her running away. I heard some stories that the women file claims (like men's abuse claims) to put men into jails/trails, then get green card automatically.

Also by filing report to USCIS, you will be saved if you meet a right one oversea and want to file K1 or CR1/IR1 again in the future.

Also by filing report to USCIS, you also are doing a right thing to protect others who would possibly be hurt by her in the future, and stand up for justice.

You are lucky that you did not marry her. Otherwise, you will be responsible for all bills from her such as what you worry about.
