as far as ive read- it states there - that if we continue to process our nvc and the visa is not released yet 0 within a year - then youll have to resubmit the papers and repay all what you have paid - is it true? i hope its not...

No it is not true at all! May be papers are resubmitted but fees are submitted for once only.

Yes my priority date was not current but right after the approval of my case from USCIS California Service Center my case was sent to NVC. NVC started my consular processing by sending the CHOICE of Agent form to the petitioner. Actually NVC starts your consular processing when they think that a visa is likely to be available within 9 months. But this does not mean that a visa will definitely be available within nine months, remember the word 'LIKELY'. The time can be increased or can be shortened too. On the other hand, if NVC reviews your case and they think that a visa will not be available within 9 months or so, they issue you a letter stating that we do not have visas right now as soon as your PD becomes current or close to be current we'll start with your consular processing. I hope that clears you.
