Good Morning Everyone... After 5 years of a " stable " relationship, long 7 months with nights without sleep and thousands of dollars spend in lawyer, USCIS fees and trips there, unfortunally I have noticed after my fiancee got his visa things has changed and two months after he got it he is not doing the effort to be here with me, instead he only respond he has six months to enter USA, and his atitude towards me and the relationship has changed, I have been aware by his sister of infidelity while me suffering here for him. At this point I do not want to marry him anymore and I would like to do a visa withdrawal. Does anybody knows what should i say and where should I send it ? I am devastated I never thought I will be going through this situation !!! Thanks

The visa has been issued. You can't withdraw the petition now. He can use the visa to come to the US, if he chooses to do so. However, you are not obligated to marry him or help him adjust status. If he comes to the US and doesn't marry you then he won't be eligible for a green card, and his status will expire in 90 days. He'll either have to leave the US or remain without lawful status. Because he has a K1 visa, he can only adjust status by marriage with the K1 visa petitioner, which means you. There would be no other practical way for him to get a green card.

Second, DO NOT MARRY HIM!!!! I don't know you but you deserve SO much better!!!! and there is SO much better out there!!!!

Let me get this right he has the visa in his passport and yet he's still in D.R.??? IS HE FOR REAL?? I'll be over the second I have that visa in my hand and the next second I'll be in my fiance's arms!!! Call the USCIS and get them to void his visa or whatever they can do so that when he tries to enter the US he can't.

Does he understand the conditions of the K1 visa?? or does he think that he has a proper immigration visa??

If he can't put the effort in now after going through the whole process then he won't put any effort into your marriage!!!

Please don't get upset by this, but could he possibly be using you?? What is his life like in D.R.??

Since your visa is already approved and issued you need to do more than contact just USCIS. It is not so simple as withdrawing the visa application now. You need to contact every agency, USCIS, NVC and the consulate to let them know you will not marry the beneficiary and the visa should be cancelled. This needs to be done in writing and you should get a confirmation back. Call the USCIS also to let them know. Do this ASAP as the visa is valid until it is cancelled by the government. Your fiance could use this to enter the country and then dissapear into the woodwork so to speak.

Sounds like this is the right decision. If your "fiance" has already been unfaithful and has this attitude now, it will only get worse once he has arrived.

I'm so sorry to hear this. If your decision is to cancel the visa the best thing to do is to communicate this with all 3 agencies: USCIS, NVC, and US embassy over there. I'm so sorry things didnt work out but if you look on the bright side better now then later....

JMO as a newbie here but would contacting the POE help and tell them your pulling out ofvisa they don't have to let him in ?? And after hearing what he's done I would not want him here

The visa has been issued and can only be canceled by the US Consulate, there's nothing USCIS can do, they don't issue visa. And since the petitioner will not marry the beneficiary the visa become useless because the sole purpose is to enter to marry the petitioner or stay home. The beneficiary can only use it to enter and live here illegally after 90 days is due.

I think the POE Officer may cancel the visa as well.

I see what you mean. I think we were just at cross purposes on the term 'cancel'. CBP can void - yes. Cancel in advance (which was what i thought you meant) - no.

Hopefully in the case of the OP's husband, the CBP officers will smell a rat and send him back if he tries to enter. If not, he will still have the problem of adjusting status without her help.

OP: In addition to calling the Embassy in Santo Domingo to see if the visa can be canceled, try contacting CBP. CBP can deny him entry.

sooo sorry you have to go through all this. I'm thinking that if he does enter the US, you may be able to contact ICE at some point? Be strong and don't marry him, no matter how heartbreaking this is...
