Hi

our process has been a year now and still no interview date

I was wondering if the process will be longer and at the Poe it will be already 2 years of marriage than the GC received at Poe will be IR and not CR?

Is it possible to maintain the process longer to reach this date and avoid t he CR and more expected fees?

Has anyone been through this situation and give their experience?

from the time of the interview, how much time do we have to enter the US?

what are the possibilities to postpone the interview and how much do they postpone it?

from the time of the interview, how much time do we have to enter the US?

Usually 6 months. Maybe less if the validity of the medical exam expires before then.

Our journey:

September 2007: Met online via social networking site (MySpace); began exchanging messages.
March 26, 2009: We become a couple!
September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!
June 21, 2010: Engaged!!!
September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

You can generally delay the interview by up to a year. But it depends exactly where you are in the process (and on the Embassy), and that may also effect the validity of police certificates if you delay too long after getting them!

No issues, but you will want to point out to the CBP at POE that it's been longer than 2 years since your marriage, so they don't overlook that and give you the right visa.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

While it's good to mention the two years at the POE, the foreigner better already have a visa before they present themselves at any US POE. If entitled to IR1 status upon arrival, USCIS will grant that status and produce the ten year card.

If the interview is after the two-year anniversary, mention that to the Consulate, so THEY will issue the right visa. Even with a CR1 visa, entry past the two-year wedding anniversary entitles the immigrating spouse to IR1 status and a ten year card.

Facts are cheap...knowing how to use them is precious...

By submitting everything at NVC stage, you limit your options. You can now request to delay the interview.

so if the beneficiary mentioned that at the interview or at the POE, it would not look any suspicious ?, i mean is it his right to mention that ?

Fill out your timeline if you havent done so.I started out with CR1 unfortunately I was still issued a CRI by the consulate but When I arrived at the POE, I pointed that out to the Border control Officer and he said I shouldnt worry because I will be Exiting with IR1,lo and behold I was stamped IR1 and got my 10years GC in the mail 3weeks later.So relax just follow the instructions if you reach the 2years mark before ur arrival or upon ur arrival.If your marriage is a year and a half old now then you should just relax cos the visa is good for 6months, you may decide to wait till the last month b4 you jet out.The immigrant status is determinned right at the POE.hope it helps.
