Hi all,

So just had a quick question. My wife came here in October with an approved K1. We didn't have any problems with anything. So we got married in December 2010, and now we are planning on applying for her AOS. The question is that I need to fill out another affadavit of support and I'm not sure if it will be ok this time or not. My income in 2010, was less than in 2009 as we were not as busy at work and getting hardly any overtime. I don't know if I should just add a co-sponsor or try to do it myself again.

Any suggestions? What is the process for adding a co-sponsor for this?

yes if your income does not meet the 125% poverty guideline, you will need a co-sponsor

You need to earn $18,387 for a 2 person household. If you don't earn more than that then yes you'll need a co-sponsor/joint sponsor.

To organise a co-sponsor/joint sponsor. If your co-sponsor/joint sponsor live with you (or you them) they can complete an I-864A, if they don't live with you they can complete and I-864. They need to give the same sort of supporting docs that you do. The only difference is you proved your eligibility (I.e. USC) and now they need to. They need to supply a document that proves they're a USC or LPR. They need to earn the income for THEIR household size plus the immigrant. If they live with you their income can be combined with yours, if they live away from you they need to independently earn the income for their household (if they're married though they can use their spouses income as long as the spouse signs an I-864A)

Don't forget you can also use assets to supplement the income.
