Our case (10/07/2010) is about a week past the 5 month K-1 processing time. Calling the USCIS 800# is useless. They just read to you what you already know. I wrote to my congressman a few days ago and below is the response I received. It says our case is

"currently under review with an officer. You should receive a notice of action very soon." I`m not sure whether to believe this or not. When I check my case on the USCIS website it says the last action taken was on 11/11/10. I could be wrong but if our case is currently under review with a officer wouldnt it reflect on website status? The letter also states some cases are processed in less than 5 months. Less than 5 months? How about cases that take only 30 days as I`ve seen on igor`s list? That`s messed up!

"I sent an inquiry to the California Service Center on the 7th of March and they responded advising your case is currently under review with an officer. You should receive a notice of action very soon.

A notice of action is either an approval notice, Request for Evidence, Denial Notice, Transfer Notice. It is important to note the 5 month processing times are estimates and as any response from the USCIS Service Center will indicate, there are some cases that may take additional time to review and some cases that are processed in less than 5 months.

I will follow up at the end of March to check status, but it appears you are tracking it as well.

Thanks for getting back to me. You should receive notice very soon."

My congresswoman's rep said the same thing to me (that my file was with an adjudicator). My USCIS page didn't report any of that. He also said if I hadn't heard anything in two weeks to call him back. I didn't hear anything so I called him back. After I talked to him, he worked his magic and 3 hours later, boom, news! Unfortunately, is was an RFE, but I got that all sent back right away. I called my congresswoman's rep again and said they received my RFE materials and then I got my NOA2 within 4 days.

well based on our case, our congresswoman wont be a helped at all.. we did tried to contact them several times, through phone and email, we sent them written consent stating that we authorized them to follow up our case on our behalf but they told us the same thing, that its still under the estimated processing time..

what we did, when we reach exactly 5mos, we called the CSC.. and right then we putted on request... then everything follows, badly we received an RFE.. just check my timeline and see how everything happened... i hope u received your approval anytime soon.. God bless :star:

February 15, 2011 I129F APPROVED!! Thank You Lord God...

February 22, 2011 NOA2 hardcopy received..

NVC just received our case

February 23, 2011 Got new case number from NVC via email..

March 2 and 3, 2011 Medical at St. Lukes (PASSED!)

March 7, 2011 US consulate received our case.

MArch 15, 2011 CFO guidance and counseling seminar (got the green cert)

March 17, 2011 USEM letter received via Email..

April 5, 2011 Interview.. VISA APPROVED!

April 13, 2011 Visa in hand..

April 15,2011 POE: LAX

I would say it is with the officer. Luckily you are at CSC and the estimate is 5 months +/- few days, not months like VSC. Sure you ll hear something over next week. Gluck !

Just my opinion..But it really bugs me when people start calling they're congressmen after waiting only 5 months or so,why don't you just hang on untill you actualy have something important to deal with,unstead of the trivial "I waited 5 months now lets call in the army!" this doesen't happen overnight folks,It's a long drawn out process mine took over a year and I never called my congressman..relax and have some patiance.

The way I think of it, I want to be with my fiance as soon as we can, so I am going to do anything in my power to keep things moving. This whole process is much longer than it should be, and so when USCIS claims it will take a certain amount of time, and it takes longer, I think people are totally justified in calling them out on that. If they said from the beginning it will take 7 months, then fine, I would wait the 7 months. I don't think people are trying to rush or don't have patience, I think we just want the work done within the time frame the USCIS, itself, set up. For me, I don't really have the option to go and visit my fiance right now, communication is difficult, no internet, no steady cell service, he doesn't even have a post office box that I can send mail to, so the sooner we get our NOA2, the closer we are to being together again. It is a long, drawn out process, but the NOA2 is only halfway through, for my fiance, he still has to travel to another country he has never been to, speaking a language that isn't his native one, and go through the medical/interview process. So of course I am anxious to get started on that. Plus, that is what our congressmen are for; they are there to help their constituency and act as a liaison. Its not about not having patience or being high strung, its about keeping the process going and being proactive about getting the service that USCIS claims it provides.

April 18, 2011 - NOA 2 received, finallllllly!!!!

April 26, 2011 - Got NVC Case Number

April 27, 2011 - NVC shipped case to Embassy in Dakar

June 7th, 2011 - Interview in Dakar- APPROVED!!

Because A)It's my right, your right, everyones right as a citizen, B)They have a section for help with a Federal Agency, C)VSC is lying out their @$$ to U.S. citizens about process times, and D)That's your problem for not calling your congressman or Senators and waiting a year. E)Your fiance/fiancee came from Canada, which is a very easy wait.

Some people will be passive like you and some will be proactive. Proactive more often than not get results. Life is short and I have no time to deal with a government agency or their bureaucratic lies.

Totally agree. joevegas is fortunate in having a fiance(e) from Canada, which means cheap, easy communication and the possibility for visits on both sides cheaply and easily. The cheapest I've ever been able to call my fiance is at 28 cents a minute, which is crazy. And forget about him every being able to visit me, its impossible to get a tourist visa for a single, male, in Mali because they claim you won't return (even if you try to explain that you need to return to complete your k-1 visa process). Plus, Mali is a muslim country that has had problems with terrorist camps in the desert, which means we will definitely be put on AP even after the interview is over. I'm not trying to complain, we all have difficulties and problems to deal with and I think a lot of us are in the same boat, and I'm happy to deal with them if it means being with my fiance at the end of all this, but I'm certainly going to do everything I possibly can to be with him as soon as I can. Besides, they give us the 5 month mark to begin with, if they didn't want us to have a reference point, they wouldn't say it.

lol..Maybe so..I'm just saying you should use your congressman as a last resort,If everybody starts calling them at the drop of a hat they are just going to become useless....

I must agree with the majority here, being proactive could have made a lot of people's year waiting period much shorter. But different strokes for different folks I guess! I filed inquiries with both senators and a congressman the day of and after 5 months. One case worker also claimed my file was with an adjudicator and to call back if nothing had happened in two weeks. I will be calling first thing Monday! USCIS has no excuses, 5 and a half months with nothing, what a joke! :wow:

09/21/10 - I-129F Sent!

09/23/10 - I-129F Received in Dallas, TX

09/28/10 - Text & E-mail NOA1 (It was at 12:44AM, weird) Notification that our case was transferred to VSC.

09/29/10 - Check cashed

09/30/10 - NOA-1 Hard Copy dated Sep. 27, 2010

10/03/10 - TOUCH!

After numerous calls to USCIS, my two Texas Senators and a Congressman, the latter got an "expedite" put through (if you can call a month and a week after ONPT an expedite). Just never let up! Even though mine took way too long, there were people who were a month before me and waited longer because they just sat back and watched. "The squeaky wheel gets the grease!"

03/31/11 - NOA-2!

04/05/11 - Received NOA-2 hard copy.

04/07/11 - NVC Received

04/12/11 - Case left NVC via DHL

04/14/11 - Consulate Received Hard Copy of Case

its your right to contact a congressman,no doubt,but dont expect any sort of supernatural show of power from their end.

if USCIS service centers can lie so shamelessly to people,there is no reason for them to be honest with the congressmen and senators?

lets face it,to people who are still waiting for their noa 2 to get approved,USCIS is god and there is no one who can make them do anything.they've got excuses up their sleeves ( now i sound like the infamous AL )

if everyone called after 5 months and 1 day waiting, the system would be clogged up, over-burdened and useless.

My heart goes out to those waiting, but using the "heavy artillery" when a field rifle will do, is not being a smart player in the game of life.

I disagree,I think people that are in a bind should definately call they're congressman,but because it's only been 5 months of waiting?...Sorry not importnt enough reason for me.

Thats maybe good for u but not for others . (1 ) --u can just jump on a plane or take a road trip and see yr fiancee once a month , (2) It is easy and cheap to communicate with each other , (3) Maybe you guys have all the time in the world before you marry and start a family , (4) you dont miss having yr love ones close to u . I am just saying :lol: . Calling or sending a request to my congressman is my democratic right as a Us citizen .
