VWP Overstay! Starting to Panic!

I just want to add/reiterate that doctorbeat's wife can get a letter from her employer about the raise and that will suffice as proof of current income. (You need either a letter from employer or 6 months paystubs). And yes, the worst that can happen is an RFE for co-sponsor. I don't think that will happen, because current income is sufficient, but it's always nice to know the worst case isn't so bad :) Good luck and get filing you two!

For Lisa, that's very interesting what you said about the other VWP overstays in Chicago. Thanks for the info.

Well what we were concerned about is having the affidavit turned down and thus not even getting as far as the interview.

If we make it as far as getting an interview, we will have loads more pay stubs and (providing I get a work permit in time) we'll have my wages to add to the total via an I-864A

If you get an RFE then everything will pause and you get X amount of days to respond. You wouldn't go to interview and then give them more paperwork (no need for I-864A btw, you are spouse and intending immigrant so you could be added to your wife's I-864). Anyway, I really really doubt you'd get an RFE. USCIS isn't discretionary on this from what I have seen, if you make the threshold based on current income (as long as you have proof of current income) then it's accepted. Get the employment letter and call it a day :)

Another aside, if you have savings or other assets, you can also add that to last years at a rate of 3:1 to make up the little difference you need... just to qualify on all sides. If not, like I said, I doubt you'd be getting an RFE anyway.

That's also going to be tricky, she works for a small independant drugstore and they don't really have things like official business stationary.

I suppose as long as the letter has all the business details etc on it, and we send a few pay stubs, that will prove that it's legit.

I hate all this, it seems that every little detail give us some kind of problem :(

Oh, and thanks for the info about savings, assets etc, but we already thought of that too.

We've been banging our heads against this problem for over a year now, so we've covered all the standard options.

Don't stop posting stuff like this though, I hope maybe this thread will help some other couple one day, so it's good to have all the options on record

Your adjusted gross income does not matter in this process.

You did the math right the first time. $12.50 x 40 x 52.

Then add in the child support. You can only claim the child support that you can document.

That's my way of thinking. By the time you get the interview you should have more pay stubs and maybe even a co sponsor just in case.

Lisa--I really think you were blessed because the district you adjusted in is one of the ones that had a clear ruling but these waivers are discretionary so maybe your mitigating factors were what swayed the Immigration Officer and the other two denials had something that swayed the other way. As I said it seems very piecemeal.
