Green Card Denied

Hello

So I had my interview this morning, it went well and everything, got grilled on just about every question in the book, but I got denied, they want my husband to take a paternity test prove for our daughter who was born before the marriage, the officer said it would save us later down the road if anything were to happen. I did not expect this at all, we have all the evidence and everything proving this relationship and every legal aspect of it, but I guess if it will save me later I cant complain, anyone in this position?

Are you actually denied, or have they just not decided yet? If your case is still under review then you might as well find an inexpensive DNA place that has the correct certifications and get it over with.


Our VisaJourney started July 2009 when I mailed the 129-F

Fiance here February 2010, married 10 days later

GC received in the mail 10-Jun-2010

Able to apply to remove conditions 12-Feb-2012

BABY GIRL BORN JULY 2011!!!

Its still under review in the system, till we get the test done once they get the results they will call us back in, we booked for feb 21st to get the test done

Did you get a paper saying you were denied or sign removal papers?

Or did they ask you to send in the DNA test and put your application on hold until they review the DNA and the case?

Ye its on hold till we get this test done, which is about the only thing keeping me sane about it all

Something doesn't make sense here. If they really denied you, why would they ask for a patternity test to be scheduled?Looks like your case is under additional review, not denied.

Something, somewhere raised a bright red flag to your IO. If your spouse is the father of your child, I wouldn't worry too much. If not - they can deny AOS and they can even revoke your K-1 visa. Hopefully it's not gonna be your case. Good luck!

never heard of such but you just have to go through with the set appointment in Feb. and update USCIS accordingly.

No he is the father that isnt the issue I just wonder what made them want to believe he may not be, he also filed an affidavid to establish paternity when we applied for her US citizenship,

Why do they need for a DNA test? I'm asking because I'm petitioning my fiance and we have son too, so we would know what to do in the future just like your case. How old is your daughter? my son is only 15 months old.

She's 21 months old, was your son born before you got married or since?

Have you filed to establish US citizenship for him? he is automatically a US citizenship born to a US parent, because he was born in Canada you need to file for a counselor of birth born abroad along with a affidavit to establish paternity if he was born out of wedlock. We applied for my daughters as soon as she was born, we got her certificate in the mail later then applief for her passport. My hubby had to aslo establish her paternity because we were not married. In my case they also found out that I stayed with my hubby in Florida for four months at the time he was living there and its where we petitioned for orginally, I went back to canada november 2009 and received my NOA2 on the 25th of that month,

Agreed.

The child alone isn't proof of relationship but can help or hinder if you lied about it. Here is a copy of the fraud referral sheet: http://graphics8.nytimes.com/packages/pdf/nyregion/USCIS_Fraud_Referral_Sheet.pdf and you can see that there is a reference to kids born in the marriage to other people, but there are other things as well.. it's not a sole disqualifier so there has to have been other negatives.

Right now it appears that you've failed to prove your relationship and if you prove the child is his that's one step closer to proving your relationship.. but I doubt the child alone would prove it... I would prepare for a Stokes interview if I were you.

It definitely seems like they've either found something, or someone has sent a letter or called to report your relationship as fraud.
