K-1 & K-2 visa's in different countries

Need Help, My Fiancee is a filipino who was working in saudi arabia but her daughter was living with grandmother in philippines. 15 year old Daughter was listed on I-129f. Fiancee was denied visa in Riyahd until she sent in custody papers for daughter. She complied, and her visa was sent to her in the mail. She flew to USA 12/11/2010 and we wed 12/30/2010. Now no one at Saudi embassy or USCIS can tell us how to get the k-2 visa for daughter in philippines. Should we wait to adjust status of my fiancee until we can get the k-2 visa? We've e-mailed manila but still no reply. Any insight would be appreciated.

What she needs to do is to adjust her status first. then look into possibly doing an I-130 petition for alien relative you can qualify as a step parent. goodluck!

Thanks, but I was still hoping to get the K-2 visa :)

The problem is that the consulate that issued the K-1 ultimately handles the K-2 case, they probably will not ship the case to the consulate in different country as follow to join.

You may want to call DOS Visa services in the USA and ask, they may know if can send the follow to join K-2 case to a consulate in different country than handled the K-1. USCIS does NOT issue or handle visas, DOS does. (202) 663-1225

As the other post said, use K-1, marry, then immediately file an I-130 for a CR-2 visa for step child, this may actually save you some $$ avoiding having to adjust status from a K-2 to get green-card, the CR-2 gets card upon entry to the USA, can then get SSN immediately too, which may help enroll in school.

They WILL do this in most cases. Get the K-1 and then have the case sent to Manila to do a K-2 to follow. The K-1 MUST be issued first or at the same time as the K-2. Since they are in separate countries, then you have to do the K-2 after. OR,is it possible for the girl to join her mother in Saudi Arabia prior to the interview and go to the interview with her there and submit her visa application with her mother?

The CR-2 is another option that will remain open until the girl is age 21. Enrolling in school is not a problem. We have two K-2s in our family and our son, age 13 when he arrived, started school the day after arrival with no SSN.
