married to US citizen with expired visa, what forms to file?

Guys, maybe a silly question :) but still, does anyone know whether i need an apostille on the copy of my birth certificate?

Neither my wife (Spanish citizen) or I (USC) had an apostille on our birth certificates, and we didn't have any problems. We sent original copies of our birth certificates.

Hey guys,

My name is Luc, I am a USC and my wife's Tourist Visa expired before we've married. I would appreciate your help in regard to which forms I have to file for her GC, especially if I have to file I-485 Supplement A ($1000 fine). Thank you all, and good lock!

First of all, it is always better to start your own thread for a new topic than to post under a 6-month old one.. just for future reference :)

Secondly, you will go the exact same process as the original poster of this particular threat: Adjustment of Status from non-immigrant visa to legal permanent resident. This means you will submit form I-130 and I-485 together, with all supportive documentation for which you will find very detailed lists here on VJ under the "guides" link. The instructions for those forms also tell you what you need to submit with them. Your wife has to get a medical done by a designated civil surgeon before filing the forms. Do not apply for the I-131 advance parole document - because she has overstayed, she will not be able to leave the US until she has her GC in her hand.

03/03/2011 - Day 0 - AOS -package mailed to Chicago Lockbox

03/04/2011 - Day 1 - AOS -package signed for at USCIS

03/09/2011 - Day 6 - E-mail notification received for all petitions

03/10/2011 - Day 7 - Checks cashed

03/11/2011 - Day 8 - NOA 1 received for all 4 forms

03/21/2011 - Day 18 - Biometrics letter received, biometrics scheduled for 04/14/2011

03/31/2011 - Day 28 - Successful walk-in biometrics done

05/12/2011 - Day 70 - EAD Arrived, issued on 05/02

06/14/2011 - Day 103 - E-mail notice: Interview letter mailed, interview scheduled for July 20th

07/20/2011 - Day 139 - Interview at Federal Plaza USCIS location

07/22/2011 - Day 141 - E-mail approval notice received (Card production)

07/27/2011 - Day 146 - 2nd Card Production Email received

07/28/2011 - Day 147 - Post-Decision Activity Email from USCIS

08/04/2011 - Day 154 - Husband returns home from abroad; Welcome Letter and GC have arrived in the mail

("Resident since" date on the GC is 07/20/2011

You do not need the supplement. If you read the instructions carefully, you will see it does not apply to you. Good luck.

2/06/13: APPROVED!
